NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Todd J. Pelkey to Mortgage Electronic Registration Systems, Inc., as nominee for Academy Mortgage Corporation, dated April 14, 2022 and recorded in the Berkshire County (Middle District) Registry of Deeds in Book 7169, Page 159, as modified by a certain modification agreement recorded on March 17, 2025, and recorded with said Berkshire County (Middle District) Registry of Deeds in Book 7792, Page 132, of which mortgage the undersigned is the present holder, by assignment from: Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Academy Mortgage Corporation, its successors and assigns to PennyMac Loan Services, LLC, recorded on July 20, 2023, in Book No. 7453, at Page 47 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 12:00 PM on July 22, 2026, on the mortgaged premises located at 246 Dalton Avenue, Pittsfield, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, TO WIT: Beginning at the intersection of the southerly line of Dalton Avenue with the easterly line of a proposed street or way to be known or now known as New Jersey Avenue, said point being sixty (60) feet easterly measured along the southerly line of Dalton Avenue from the northeast corner of land now or formerly of one Bonin; running thence southerly at right angles to the southerly line of Dalton Avenue and along the easterly line of said proposed street to be known or now called New Jersey Avenue, one hundred twenty-four (124) feet to a point; thence easterly to a line parallel to the southerly line of Dalton Avenue, seventy (70) feet; thence northerly in a line parallel to the easterly line of said proposed street, or now existing street, namely New Jersey Avenue, one hundred twenty-four (124) feet to a point in the southerly line of Dalton Avenue; thence westerly along the southerly line of Dalton Avenue, seventy (70) feet to the place of beginning. Said parcel of land sometimes is known as Lot 13, Block J, on a plan of Allendale. Subject to restrictions, if any, insofar as the same may still be in force and applicable. Meaning and intending to describe the same premises set forth in the deed dated 10/27/2017 and recorded on 10/27/2017 in Book 6084 at Page 53 in the Official Records of the Berkshire (Middle District) Recording Office. See also Petition for Partition Docket Number 20E0004 appointing Gary A. Case as commissioner. For mortgagor's(s') title see deed recorded with Berkshire County (Middle District) Registry of Deeds in Book 7169, Page 155. These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. TERMS OF SALE: A deposit of Five Thousand ($5,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
