LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Suzanne Turner to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Mortgage Lenders Network USA, INC., its successors and assigns, dated June 12, 2006 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 3578, Page 222 (the "Mortgage"), as affected by an Order dated June 11, 2025, and recorded at said Registry of Deeds in Book 7857, Page 111 of which mortgage U.S. Bank National Association, as Trustee, for RASC 2006-EMX7 is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Lenders Network USA, Inc., its successors and assigns to U.S. Bank National Association, as Trustee, for RASC 2006-EMX7 dated September 12, 2012 and recorded at said Registry of Deeds in Book 5038, Page 3, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 15 Lake Street, Pittsfield, MA 01201 will be sold at a Public Auction at 1:00 PM on December 2, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: The land in Pittsfield, Berkshire County, Massachusetts, bounded and described as follows: Being Lot No. fifteen (15) on the plan of lots described on a map of the Durant lot, so-called, now or formerly owned by Henry Noble of said Pittsfield, said plan being deposited with the Registry of Deeds at said Pittsfield, reference being had to said plan; bounded westerly by lots Nos. eight (8) and nine (9) on said plan northerly by lot No. sixteen (16) on said plan; easterly by lot No. twenty (20) on said plan, and southerly by Lake Street so called. Also all our right, title and interest in and to the following described parcel of real estate in said Pittsfield, Bounded on the east by the east line of lot number fifteen on the plan of lots described on a map of the Durant lot so-called, formerly owned by Henry Noble of said Pittsfield; on the north by the lot number sixteen on said plan; on the west by land of one Blaine, now or formerly, along a line parallel with the east line of said lot number fifteen and two feet distant therefrom; and on the south by Lake Street, so-called. The above description as transcribed corrects a typographical error in the mortgage description which incorrectly recites that the subject lot is bounded westerly by lots Nos. eight (80). For mortgagor's title see deed recorded with the Berkshire County (Middle District) Registry of Deeds in Book 3578, Page 220. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication. Other terms to be announced at the sale.
