MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by LISA A. POPLASKI to GREYLOCK FEDERAL CREDIT UNION, dated April 7, 2015, and recorded on April 7, 2015, with the Berkshire Middle District Registry of Deeds in Book 5533, Page 191, of which mortgage the undersigned is the present holder, for breach of the conditions of the said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 10:00 a.m. on the Fifteenth (15th) day of December, 2022, at the mortgaged premises described below, to wit, 30 Dan Avenue, Pittsfield, Massachusetts, all and singular, the premises in said Pittsfield, Berkshire County, Massachusetts, described in said Mortgage, to wit: The southerly fifty (50) feet of Lot seventy-seven (77) and the northerly fifty (50) feet of Lot number seventy-six (76) as shown on a Plan of Dan Avenue laid out by Daniel Gall and Daniel Gall, Jr., dated September 1, 1955, William A. Heaphy, Engineer, and recorded in the Berkshire Middle District Registry of Deeds in Book 417 E, Page 15. Said lot has a frontage on Dan Avenue of one hundred (100) feet and a depth of one hundred fifteen (115) feet. This conveyance is made subject to the following restrictions: 1. That only one single family house costing not less than $10,000.00 and a garage attached to the house for not more than two cars for private use, and no portion of any other dwelling house or garage, shall be erected on said premises. 2. That no cattle, animals or poultry of any description, other than a household pet, shall be kept on said premises. This conveyance is made subject to an easement given by Daniel Gall and Daniel Gall, Jr., to the Western Massachusetts Electric Company and the New England Telephone and Telegraph Company. In the event the successful bidder shall default in purchasing the within described premises according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with the Mortgagee's attorneys, HASHIM & SPINOLA, the amount of the required deposit as set forth herein within three (3) business days after written Notice of Default of the previous highest bidder, and title shall be conveyed to the said second highest bidder within twenty (20) days of said written notice. This sale may be postponed or adjourned from time to time, if necessary, by the attorney for the mortgagee at the scheduled time and place of sale.
