MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by James Fox and Denise K. Fox to TD Bank, N.A. dated August 4, 2016 and recorded with the Berkshire County Registry of Deeds in Book 05824, Page 291 of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 11:00 o'clock, A.M. on the 19th day of August 2021, on the mortgaged premises described below, being known as 25 North Lake Way, Becket, Massachusetts all and singular the premises described in said mortgage, to wit: Beginning at a stake in the westerly line of North Lake Way, so-called, as shown on a plan entitled ''Map 6647-2 Roads and Beach Area of Land of The Center Lake Estates. Inc., Becket, Mass., Scale 1 in. to 60 ft., July 1, 1951, A. J. Kohlhofer, Engineer, Pittsfield, Mass. and recorded in the Berkshire Middle District Registry of Deeds in Drawer 225, said stake being 30 feet northerly of an angle in said westerly line of North Lake Way; Thence running North 20 Degrees. 02 Minutes West along said westerly line of North Lake Way 65.00 feet to a stake; Thence running North 84 Degrees. 32 Minutes West 159.75 feet to a stake; Thence running North 84 Degrees. 32 Minutes West 25 feet. more or less, to the shore of Center Lake so-called; Thence running Southeasterly along said shore of Center Lake 80 feet, more or less, to a point; Thence running South 86 Degrees, 02 Minutes East 6 feet, more or less, to a stake; Thence running South 86 Degrees, 02 Minutes East 173.37 feet to the place of beginning. Also conveying all grantors right. title and interest if any they have, to that area lying between the above-described parcel and the low water mark of said lake and bounded by the extension westerly of the northerly and southerly line of said parcel. The above premises are conveyed together with those rights and subject to the restrictions and easements set forth in the deed of Center Lake Estates, Inc., to Walter R. Monette et ux dated August 27, 1954 and recorded in said Registry of Deeds in Book 617 page 151. Subject to the terms of that agreement known as the Center Lake Estates Trust Agreement recorded in the said Registry in Book 615, Page 209 &c. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale date. Said premises will be sold subject to and with the benefit of all restrictions, easements, improvements, outstanding tax titles, mortgages, liens, rights of tenants and parties in possession, unpaid taxes, municipal liens and other public taxes, assessments, or liens, having priority over the mortgage described herein, if any. In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with Mortgagee's attorneys, Shaheen Guerrera & O'Leary, LLC, the amount of the required deposit as set forth herein within three (3) business days after written notice of default of the previous highest bidder and title shall be conveyed to said second highest bidder within twenty (20) days of said written notice. TERMS OF SALE: A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) shall be required to be paid to the mortgagee by certified or bank treasurer's cashier check payable to "Shaheen Guerrera & O'Leary, LLC "at the time and place of sale. The high bidder to increase deposit to equal 10% of the total purchase price within 5 days of the auction. The balance of the purchase price is to be paid by federal funds wire transfer, certified check or by bank check in or within forty-five (45) days from the date of the sale payable to "Shaheen Guerrera & O'Leary, LLC", at 820A Turnpike Street, North Andover, MA 01845. A foreclosure deed will be provided to purchaser for recording upon payment in full of the purchase price. The description of the premises contained in said mortgage shall control in the event of an error in this publication. The purchaser shall be required to sign a Memorandum of Sale at the time and place of sale. TIME WILL BE OF THE ESSENCE. Other terms, if any, to be announced at sale.
