MORTGAGEE'S SALE OF REAL ESTATE Premises: 1561 Cold Spring Road, Williamstown, MA By virtue and in execution of the Power of Sale contained in a certain mortgage given by SB PROPCO LLC to OXFORD FINANCE LLC dated July 9, 2014 and recorded in the Land Court at the Berkshire Northern Registry of Deeds in Book 00023, page 2241, Document No. 13123, of which mortgage the undersigned, OXFORD FINANCE LLC, is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 1:00 P.M. on the 6th day of November, 2020, upon the mortgaged premises at 1561 Cold Spring Road, Williamstown, Berkshire County, Massachusetts all and singular the premises described in said mortgage, to wit:: A certain parcel of real estate situated in Williamstown, Berkshire County, Massachusetts being the premises known as #1561 COLD SPRING ROAD - LOT 7, LAND COURT PLAN 3120 ) ("Sweet Brook Parcel"), Williamstown, Massachusetts, more particularly bounded and described as follows: The registered land, with buildings thereon, located on the westerly side of Cold Spring Road, also known as Massachusetts State highway and formerly known as Hemlock Road, Southeasterly by the westerly line of said Cold Spring Road, one hundred eighty-three and 61/100 (183.61') fee; again Southeasterly by the westerly line of said Cold Spring Road, two hundred forty-four and 81/100 (244.81') feet; again Southeasterly by the westerly line of said Cold Spring Road, four hundred fifty-four and 2/100 (454.02') feet Southwesterly by the northerly line of Lot 8 as shown on Land Court Plan 3120, seven hundred forty-eight and 67/100 (748.67') feet; Northwesterly by land now or formerly of W.E. Harmon, eight hundred five and 79/100 (805.79') feet; and Northeasterly by the southerly line of Woodcock Road, six hundred thirty-one and 46/100 (631.46') feet. Being Lot 7 as shown on Land Court Plan 3120 filed with Certificate of Title no. 2155 in the records of the Land Court at the Berkshire Northern District Registry of Deeds (the "Registry") The Property is subject to the following: 1. Rights of the Mt. Greylock Regional School District, a regional public school and respecting use of a pat and otherwise as set forth in an unrecorded Revocable License Agreement dated December 13, 1991; 2. Rights of the President and Trustees of Williams College, and educational corporation, and respecting use of a path and otherwise as set forth in an unrecorded Revocable License Agreement Dated Marcy 27, 2007, between Northern Berkshire Community Services, Inc. and said college. 3. Rights of the occupants of Sweet Brook Nursing Care Center and Sweetwood Continuing Care Retirement Community, of the Mt. Greylock Regional School District, and of the President and Trustees of Williams College, in or to a walking path or cycle path. Being the same premises conveyed to SB Propco LLC by Quitclaim Deed of 1561 Cold Spring Road, LLC dated May 30, 2014 recorded in the Land Court at the Berkshire Northern Registry of Deeds in Book 00023, Page 2241, Document No. 13120 on June 11, 2014. The above premises will be sold subject to and/or with the benefit of any and all restrictions, easements, improvements, outstanding tax titles, municipal or other public taxes, assessments, liens or claims in the nature of liens, and existing encumbrances of record created prior to the mortgage, if any. The premises are also sold subject to the right of redemption of the United States of America or any of its subsidiaries or divisions, if any there be. In the event of any typographical error set forth herein in the legal description of the premises, the description set forth and contained in the mortgage shall take precedence. In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of foreclosure, the Mortgagee reserves the right to sell the property by foreclosure deed to the second highest bidder, providing that the second highest bidder shall execute a Memorandum of Sale and deposit with Mortgagee's attorneys, Weiner Law Firm, P.C., 1441 Main Street, Suite 610, Springfield, Hampden County, Massachusetts, the amount of the required deposit as set forth herein within three (3) business days after written notice of the default of the previous highest bidder.
