COMMONWEALTH OF MASSACHUSETTS The Trial Court Probate and Family Court Department Berkshire Division Docket No. BE20E0021 TO: Karin Shanley of Ashley Falls, Massachusetts and all other persons interested; A Petition for Partition, # 1 , filed September 11, 2020, has been presented to said Court by Mary Johnston of Mill River, Massachusetts, representing that she holds as tenant in common an undivided part or share in certain real estate situate in Ashley Falls, Berkshire County, Massachusetts, and described as follows: The land with buildings thereon located on the easterly side of Stahl Road in the Village of Ashley Falls, Town of Sheffield bounded and described as follows: Beginning at an iron pipe in the easterly line of Stahl Road, said pipe being 832 feet northerly from a post at a corner of land now or formerly of May Cronk; Thence north 52 degrees east 690 feet along land now or formerly of Arthur Hoag to a point in line now or formerly of one Dunham: Thence north 48 degrees west 451 feet along land of said Dunham; Thence south 42 degrees west 690 feet along land of said Arthur Hoag to an iron pipe in the easterly line of Stahl Road; Thence southerly along Stahl Road 451 feet to the place of beginning. containing 7.14 acres. Excepted from said conveyance is that .22 acre parcel of land shown on a plan recorded in the SOUthern Berkshire District Registry of Deeds inPlat FileC-I. BEING all and the same premises as were conveyed to the grantors herein, Barry A. Davidson and Charlotte L. Davidson, by deed of Jane Sherman, f/k/a Jane Sherman Marfilius, dated June 18.2003 and recorded on June 26, 2003 with the said Southern Berkshire District Registry of Deeds in Book 1436, Page 301. setting forth that she desires that all of said land may be sold at private sale for not less than $450,000.00 or at public auction and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 30th day of October, 2020, the return day ofthis citation.
