NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Eisler Family RE, LLC, a Massachusetts limited liability company, to Corevest American Finance Lender LLC, a Delaware limited liability company, dated March 28, 2019, and recorded at the Berkshire County (Middle District) Registry of Deeds in Book 6377 at Page 201, of which mortgage the undersigned is the present holder, by assignment from Corevest American Finance Lender LLC to CF Corevest Purchaser LLC dated April 3, 2019 and recorded with the Berkshire County (Middle District) Registry of Deeds in Book 6684 at Page 111; as further assigned from CF Corevest Purchaser LLC to CAF Borrower GS LLC dated April 3, 2019 and recorded with the Berkshire County (Middle District) Registry of Deeds in Book 6684 at Page 116; as further assigned from CAF Borrower GS LLC to CAF REO-2, LLC dated August 7, 2020 and recorded with the Berkshire County (Middle District) Registry of Deeds in Book 6687 at Page 230, for breach of conditions of said mortgage and for the purpose of foreclosing the same, will be sold at PUBLIC AUCTION at 12:00 o'clock P.M. on the 16th day of October, 2020 at 7 Hawthorne Road in Stockbridge, Berkshire County, Massachusetts 01262, all and singular premises described in said mortgage To wit: The land with the buildings thereon, situated in Stockbridge, Berkshire County, Commonwealth of Massachusetts, bounded a described as follows: Beginning at a point in the east line of Mahkeenac Road and at the northwest corner of land being conveyed, said point being 235 feet southwest corner of land conveyed by Walter Wilson, et als, to Schierloh Builders, Inc., by deed dated May 10, 1955 and recorded in the Berkshire Middle District Registry of Deeds in Book 626, Page 54; Thence N 85'06'-E 209.50 feet to the west line of said land of Schierloh Builders, Inc., Thence S 04 06' E along said land of Schierloh Builders, Inc. 125 feet; Thence 85 06' W 209 feet to a point in the east line of Mahkeenac Road; Thence northerly along the east line of said Mahkeenac Road 125 feet to the place of beginning. Subject to the same covenants, obligations, restrictions, easements, privileges and rights, and together with the same covenants, obligations, restrictions, easements, privileges and rights, so far as they apply to the premises being conveyed, set forth in said deed from the said Walter Wilson et als, to the said Schierloh Builders, Inc., all of which are incorporated herein and made a part hereof by reference thereto. Notwithstanding anything hereinbefore mentioned, it is agreed that neither the Grantees nor anyone claiming under them shall have the right to connect with any existing sewage pipes or system which may be located on the premises conveyed by Lena Lydia McGregor, et al, to Mahkeenac Lake Development Company, of which the conveyed premises are a part, by deed dated August 3, 1949 and recorded in said Registry in Book 557, Page 167. Subject to the same covenants, obligations, restrictions, easements, privileges and rights, and together with the same covenants, obligations, restrictions, easements, privileges and rights, so far as they apply to the premises being conveyed, set forth in said deed from the said Walter Wilson et als, to the said Schierloh Builders, Inc., all of which are incorporated herein and made a part hereof by reference thereto. The premises are conveyed with the benefit of an agreement by said Walter Wilson, et als, to extend the water line by July 1,1957, now serving the said land conveyed to Schierloh Builders Inc., to the southerly line of the conveyed premises, and subject to the right of said Walter Wilson, et als, to extend the said water line in a northerly direction across the conveyed premises to other land now or formerly owned by the said Walter Wilson, et als, adjacent to the conveyed premises and to the north premises, with the right unto said Walter Wilson, et als, to repair and replace the same whenever necessary, doing as little damage as possible. Subject to an easement to Southern Berkshire Power and Electric Company dated February 14, 1950 and recorded in the Berkshire Middle District Registry of Deeds in Book 557 Page 341, if applicable. Subject to an easement to Southern Berkshire Power and Electric Company dated June 7, 1951 and recorded in the Berkshire Middle District Registry of Deeds in Book 557, Page 639, if applicable. The premises are conveyed with the benefit of an agreement by said Walter Wilson, et als, to extend the water line by July 1,1957, now serving the said land conveyed to Schierloh Builders Inc., to the southerly line of the conveyed premises, and subject to the right of said Walter Wilson, et als, to extend the said water line in a northerly direction across the conveyed premises to other land now or formerly owned by the said Walter Wilson, et als, adjacent to the conveyed premises and to the north premises, with the right unto said Walter Wilson, et als, to repair and replace the same whenever necessary, doing as little damage as possible. Being the same premises conveyed to the mortgagor herein by deed of Howard Eisler, which deed was recorded on April 1, 2019 in the Berkshire Middle District Registry of Deeds, Book 6377, Page 198 Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: A deposit of five thousand dollars ($5,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Demerle Hoeger LLP, 10 City Square, 4th Floor, Boston, MA 02129 within thirty (30) days from the date of sale, time being of the essence. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale-date by public proclamation at the time and date appointed for the adjourned sale date. In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of foreclosure, the Mortgagee reserves the right to sell the property by foreclosure deed to the second highest bidder, providing that said second highest bidder shall deposit with the Mortgagee's attorneys, the amount of the required deposit as set forth herein. If the second highest bidder declines to purchase the within described property, the Mortgagee reserves the right to purchase the within described property at the amount bid by the second highest bidder.
