NOTICE OF MORTGAGEE?S SALE OF REAL ESTATE Premises: 215 Houghton Street, North Adams, MA 01247 By virtue and in execution of the Power of Sale contained in a certain mortgage given by Kimberly Ann Meczywor and Theodore Stanley Meczywor II to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Guild Mortgage Company LLC, and now held by Village Capital & Investment LLC, said mortgage dated April 23, 2024 and recorded in the Berkshire County (Northern District) Registry of Deeds in Book 1853, Page 655, said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Guild Mortgage Company LLC to Village Capital & Investment LLC by assignment dated November 19, 2025 and recorded with said Registry of Deedsin Book 1904, Page 111; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on May 18, 2026 at 11:00 AM Local Time upon the premises,all and singular the premises described in said mortgage, to wit: The land with any and all buildings thereon situate on the westerly side of Houghton Street, in North Adams, Berkshire County, Massachusetts, bounded and described as follows: "Beginning at an iron pin in the ground at the northeast comer of the lot marked "A" on plan entitled "Plan of Land of William & Bessie Kronick, North Adams, Mass., January 28, 1947, A.B. Wright, C.E." on file in Northern Berkshire Registry of Deeds as Plan #55 in Binder #3, to which plan reference is always to be had, said place of beginning being also the southeast comer of land of William Johnson Heirs; Thence westerly on the southerly line of land of said William Johnson Heirs 63.3 feet to an iron pin in the ground; Thence southwesterly 57.4 feet to an iron pin in the ground in the northerly line of other land of the grantors herein; Thence easterly on the northerly line of land of William & Bessie Kronick 91.76 feet to a spike in the ground in the westerly line of Houghton Street; Thence northerly 48 feet along the westerly line of said Houghton Street to the point and place of beginning. Being lot marked "A" on the aforesaid plan." UNDER AND SUBJECT to any existing covenants, easements, encroachments, conditions, restrictions, and agreements affecting this property. TOGETHER WITH all and singular the improvements, ways, streets, alleys, passages, water, watercourses, right, liberties, privileges, hereditaments, and appurtenances whatsoever hereto belonging or in anywise appertaining and the reversions and remainders, rents, issues and profit thereof, and all the estate, right, title, interest, property, claim and demand whatsoever of the said Grantor in law, equity, or otherwise howsoever, of and to the same and every part thereof. Being the same premises conveyed to the mortgagors herein by deed of Jorge Acosta and Claudia Acosta to be recorded in the Northern Berkshire Registry of Deeds simultaneously herewith. By inadvertence, the two references in the second paragraph of the above description to the word ?comer? should state ?corner?. The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. For Mortgagor?s Title see deed dated April 11, 2024 and recorded in the Berkshire County (Northern District) Registry of Deeds in Book 1853, Page 652. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser.
