Notice of Intent to Request Release of Funds (NOIRROF) April 7, 2025 City of North Adams City Hall 10 Main Street North Adams, MA 01247 413-662-3025 To all Interested Agencies, Groups and Persons: On or about October 1, 2025, the City of North Adams will request the Commonwealth of Massachusetts to release CDBG funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383) as amended for the following identified projects located within the City of North Adams, Berkshire County, Massachusetts: FY'2025 CDBG/Mini-Entitlement Program 6-B. Infrastructure - "Prospect Hill Area Roadway Improvements" (Tremont, Beacon & Wesleyan) 6-D Public Facilities - Phase IV Spitzer Senior Center Improvements 9. General Administration The activities proposed are categorically excluded or exempt under HUD's regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. Additional project information is contained in the Environmental Review Record (ERR) on file at the above address and is available for public review, and may be examined and copied weekdays upon request at the Office of Community Development (OCD), Room # 107, during the normal business hours of 8:00 am through 4:30 pm, Monday through Friday. Any individual, group, or agency may submit written comments on the ERR to the City of North Adams to the Office of Community Development, City Hall, 10 Main Street, North Adams, MA 01247, or by email at mnuvallie@northadams-ma.gov. All comments received by April 22, 2026 will be considered by the City of North Adams prior to authorizing the submission of a request for release of funds. The City of North Adams certifies to the State that the Certifying Officer, Michael F. Nuvallie, in his capacity as Community Development Specialist of the OCD, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The HUD approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of North Adams to use CDBG funds. The State will accept objections to its release of funds and the City of North Adams certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: a) the certification was not executed by the recipient's Certifying Officer; b) the recipient has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; c) the recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Massachusetts Community Development Fund/CDBG Program, Executive Office of Housing & Livable Communities, 100 Cambridge Street, Suite 300, Boston, MA 02114.
