NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Premises: 101 Brooklyn Street, North Adams, MA 01247 By virtue and in execution of the Power of Sale contained in a certain mortgage given by Kenneth Cayo and Trina Cayo to Twenty Four Realty, LLC, and now held by First National Bank of America, said mortgage dated October 1, 2020 and recorded in the Berkshire County (Northern District) Registry of Deeds in Book 1728, Page 73, said mortgage was assigned from Twenty Four Realty, LLC to First National Bank of America by assignment dated June 30, 2022 and recorded with said Registry of Deedsin Book 1799, Page 488; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on April 22, 2026 at 09:00 AM Local Time upon the premises,all and singular the premises described in said mortgage, to wit: The land with the buildings thereon in, situate on the westerly side of Brooklyn Street in North Adams, Berkshire County, Massachusetts, bounded and described as follows: bounded on the North by Lot No. 33, as marked on the Houghton Plan of Building Lots, which Lot No. 33 was formerly owned by David McElwain; on the east by said Brooklyn Street; on the South by Lot No. 31, as marked on said Plan of Lots; and on the west by Lot No. 49, as marked on said Plan, being Lot No. 32 as shown on said Plan of Lots. Meaning and intending to convey and hereby expressly conveying, in mortgage, all and singular, the same premises conveyed to the Mortgagors herein, Kenneth Cayo and Trina Cayo, by deed of Twenty Four Realty, LLC dated October 1, 2020 and to be recorded concurrently herewith in the Northern Berkshire Registry of Deeds. The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. For Mortgagor's Title see deed dated October 1, 2020 and recorded in the Berkshire County (Northern District) Registry of Deeds in Book 1728, Page 21. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser.
