COMMONWEALTH OF MASSACHUSETTS The Trial Court Probate and Family Court Department Berkshire Division Docket No. BE24E0011 TO: Harrison Sistrunk and Valerie Sistrunk, a/k/a Valerie Disiena-Eason, both of Pittsfield, Massachusetts and all other persons interested; A Petition for Partition, dated and filed August 13, 2025, has been presented to said Court by Jaelynn Sistrunk of Pittsfield, Massachusetts, representing that s/he holds as tenant in common an undivided part or share in certain real estate situate in Pittsfield, Berkshire County, Massachusetts, and described as follows: (Locus of Property: 17 Chatham Street, Pittsfield, Massachusetts) The lot shown and designed as Lot No. 30 on plan entitled "Plan of Subdivision of Property of Pontoosuc Woolen Manufacturing Co, Pittsfield, Mass.," made by A. J. Kohlhofer, Engineer, dated October, 1928, a copy of which is filed in the Registry of Deeds at Pittsfield, Mass., in Drawer No. 67. Said parcel is bounded easterly by Chatham Street, eighty-two and ninety-one one-hundredths (82.91) feet; northerly by Lot No. 29 on said plan, two hundred fifty-five and forty-one one-hundredths (255.41) feet; westerly by land now or formerly of Pontoosuc Woolen Manufacturing Co., eighty-two and ninety-one one-hundredths (82.91) feet; and southerly by Lot No. 31, on said Plan, two hundred fifty-five and forty-one one-hundredths (255.41) feet. There is also conveyed so much of Chatham Street as lies west of the center line thereof and between the extension easterly of the southerly and northerly lines of said Lot No. 30. The common title of the Petitioner and Respondents to the Property is derived under a deed of conveyance from Berkshire Fund, Inc. to Thelonious Sistrunk and Valerie Sistrunk recorded in the Berkshire Middle District Registry of Deeds at Book 3646, Page 78; Judgment of Divorce between Thelonious Sistrunk and Valerie Sistrunk, BE13D0362 dated April 4, 2014; and Formal Adjudication of Heirs in the intestate death of Thelonious Sistrunk, BE23P0364EA. Further, as set forth in the Petition, the Petitioner seeks to hold said real estate in severalty. And, if the Court finds that said Property cannot be advantageously divided, the Petitioner desires that all of said land may be sold at private sale for not less than $250,000.00 and praying that the partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition of all or any part of said land which the Court finds cannot be advantageously divided at public auction or private sale; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal.
