MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE 44 Prospect Lake Road, North Egremont, Massachusetts 01252 By virtue and in execution of the Power of Sale contained in a certain mortgage (the "Mortgage") given by PETER J. CASE, JR. also known as PETER JACKSON CASE, JR. and BETHANY TRUDEAU to LEE BANK, a Massachusetts chartered bank (the "Mortgagee") dated June 19, 2015, and recorded with the Berkshire County (Southern District) Registry of Deeds in Book 2309, Page 235, of which the undersigned is the present holder, for breach of the conditions of the Mortgage and for the purpose of foreclosing the same, there will be sold at Public Auction at 10:00 AM on the 2nd day of April 2026, at the mortgaged premises known as 44 Prospect Lake Road, North Egremont, Massachusetts 01252, all and singular, the premises described in the Mortgage (the "Mortgaged Premises"), to wit: "the following described property located in the COUNTY of Berkshire: SEE LEGAL DESCRIPTION ATTACHED HERETO AND MADE A PART HEREOF AS EXHIBIT "A". A.P.N.: 13-855 which currently has the address of 44 Prospect Lake Road, North Egremont, Massachusetts 01252: TOGETHER WITH all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Schedule A to the Mortgage reads as follows: "SCHEDULE A (to Mortgage) Beginning at a point in the northerly line of the highway leading from the Village of North Egremont to Hillsdale, New York, said point being the southeasterly corner of the parcel of land herein conveyed and the southwesterly corner lof (sic) land now or formerly of one Loeb; thence westerly along the line of said highway fifty-five (55) feet to a point; thence northerly along land now or formerly of Frances E. Lester one hundred forty-five (145) feet to a point; thence easterly along said land of Frances E. Lester fifty-five (55) feet to a point in the westerly line of land of said Loeb; thence southerly along line of said land of Loeb one hundred forty-five (145) feet to the place of beginning. Being the same premises conveyed to Peter J. Case, Jr. and Bethany Trudeau by deed of Morton E. Trudeau and Sandra L. Trudeau dated June 19, 2015 and recorded in the Berkshire County Southern District Registry of Deeds immediately prior hereto." In the event of any typographical error set forth herein in the legal description of the Mortgaged Premises, the description as set forth and contained in the Mortgage shall control by reference. The Mortgaged Premises will be sold subject to and, with the benefit of, all restrictions, easements, improvements, leaseholds, tenancies, occupants, outstanding tax titles, municipal or other public taxes, liens, or other claims in the nature of liens, and existing encumbrances of record having priority over the Mortgage. The Mortgagee makes no representations concerning the condition of the Mortgaged Premises or its compliance with applicable zoning, building, sanitary or other state and/or municipal regulations.
