MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE 96 Shore Road, Becket, Massachusetts 01223 also known as 303 Brook Lane, Becket, Massachusetts 01223 By virtue and in execution of the Power of Sale contained in a certain mortgage (the "Mortgage") given by ELIZABETH A. SHARP to LEE BANK, a Massachusetts Chartered Bank (the "Mortgagee") dated November 1, 2018, and recorded with the Berkshire County (Middle District) Registry of Deeds in Book 6303, Page 189, of which the undersigned is the present holder, for breach of the conditions of the Mortgage and for the purpose of foreclosing the same, there will be sold at Public Auction at 10:00 AM on the 13th day of March 2026, at the mortgaged premises known as 96 Shore Road, Becket, Massachusetts 01223, also known as 303 Brook Lane, Becket, Massachusetts 01223, all and singular, the premises described in the Mortgage (the "Mortgaged Premises"), to wit: "the following described property located in the COUNTY of Berkshire: SEE LEGAL DESCRIPTION ATTACHED HERETO AND MADE A PART HEREOF AS EXHIBIT "A". A.P.N.: Map 205 Lot 35 which currently has the address of 96 Shore Road, Becket, Massachusetts 01223; TOGETHER WITH all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property." Exhibit A to the Mortgage reads as follows: "EXHIBIT 'A' 96 Shore Road, Becket, Berkshire County, Massachusetts PARCEL I; Being Lots Numbered 126 (one hundred twenty-six), 127 (one hundred twenty-seven), 128 (one hundred twenty- eight), 129 (one hundred twenty-nine), 130 (one hundred thirty), 131 (one hundred thirty-one), 161 (one hundred sixty-one), 162 (one hundred sixty-two), and 163 (one hundred sixty-three) as shown on plan entitled "Mountain Grove on Shaw Lake, Becket, Mass. Map One filed with the Pittsfield Registry of Deeds in Drawer Sixty-Six of the sub-division known and designated as Mountain Grove, Massachusetts, together with an easement to the use of the property shown on said maps 1&2 as "Community Beach and Parks", for access to the Shaw Lake for bathing, boating, and other uncommercial uses, and with an easement of right of way over the streets, roads, places drives, or avenues shown on said map, but reserving, however, in such streets, roads, places, drives or avenues, the right to install telegraph, telephone and electric light poles and wires, gas and water mains or to give licenses or permits for same. SUBJECT to RESTRICTIONS as set forth in a deed of George F. Marcoullier, et al, dated September 12, 1944 and recorded in the Middle Registry of Deeds for Berkshire County at Pittsfield, Mass. in Book 506, Page 618 &c. Mead et als which said deed is recorded in the Berkshire Middle District Registry of Deeds in Book 462, Page 569 to which reference is made for more particular information and description. In the event of any typographical error set forth herein in the legal description of the Mortgaged Premises, the description as set forth and contained in the Mortgage shall control by reference. The Mortgaged Premises will be sold subject to and, with the benefit of, all restrictions, easements, improvements, leaseholds, tenancies, occupants, outstanding tax titles, municipal or other public taxes, liens, or other claims in the nature of liens, and existing encumbrances of record having priority over the Mortgage. The Mortgagee makes no representations concerning the condition of the Mortgaged Premises or its compliance with applicable zoning, building, sanitary or other state and/or municipal regulations. If the second highest bidder declines to purchase the Mortgaged Premises, the Mortgagee reserves the right to purchase the within described property at the amount bid by the second highest bidder.
