MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE 642 East Main Street Extension, North Adams, Massachusetts 01247 also known as 642 East Main Street, North Adams, Massachusetts 01247 By virtue and in execution of the Power of Sale contained in a certain mortgage (the "Mortgage") given by NATALIE J. MARTELLE and ROBERT M. MARTELLE to HOOSAC BANK (NOW KNOWN AS MOUNTAINONE BANK, SUCCESSOR BY MERGER TO HOOSAC BANK), a Massachusetts banking corporation (the "Mortgagee") dated May 17, 2000, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1004, Page 950, of which the undersigned is the present holder, for breach of the conditions of the Mortgage and for the purpose of foreclosing the same, there will be sold at Public Auction at 11:00 AM on the 12th day of February 2026, at the mortgaged premises known as 642 East Main Street Extension, North Adams, Massachusetts 01247, also known as 642 East Main Street, North Adams, Massachusetts 01247, all and singular, the premises described in the Mortgage (the "Mortgaged Premises"), to wit: "the following described property located in North Adams, Berkshire County, Massachusetts: SEE ATTACHED "SCHEDULE A" which has the address of 642 East Main Street Extension, North Adams, Massachusetts 01247; TOGETHER WITH all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property." Schedule A to the Mortgage reads as follows: "SCHEDULE A the land situate in said North Adams, bounded and described as follows: Beginning at an iron pin in the southerly line of East Main Street, 104.57 feet easterly of a Massachusetts highway bound at the intersection of the southerly line of East Main Street with the northeasterly line of Mohawk Trail, so-called; thence easterly on the southerly line of East Main Street 148.37 feet to a city street bound; thence deflecting to the left and continuing easterly on the southerly line of the East Main Street, 16.7 feet to an iron pin in the northwesterly corner of land now or formerly of John T. Marran; thence southerly on the westerly line of said land of Marran 95.75 feet to an iron pin in the northeasterly corner of land now or formerly of Myrtle B. Crofts; thence westerly on the northerly line of said land of Crofts 96.97 to an iron pin in the ground; thence turning an interior angle 98 10' and running northerly 78.65 feet to another iron pin in the ground; thence turning an exterior angle of 203 47' and running westerly 54.45 feet to another iron pin in the ground; thence turning an interior angle of 90 and running northerly 47.27 feet to the point and place of beginning. Said premises are shown on a plan filed in the Northern Berkshire Registry of Deeds in Book 240C, Page 7, entitled "Plan of land of Albert H. and Malvina E. Harvey May 22, 1946, A.B. Wright, C.E.," to which plan reference is always to be had. Meaning and intending to describe and convey, in mortgage, the same premises conveyed to Natalie J. Martelle and Robert M. Martelle by deed of Terry J. Martelle dated even herewith and recorded in the Northern Berkshire Registry of Deeds at Adams, Massachusetts." In the event of any typographical error set forth herein in the legal description of the Mortgaged Premises, the description as set forth and contained in the Mortgage shall control by reference. The Mortgaged Premises will be sold subject to and, with the benefit of, all restrictions, easements, improvements, leaseholds, tenancies, occupants, outstanding tax titles, municipal or other public taxes, liens, or other claims in the nature of liens, and existing encumbrances of record having priority over the Mortgage. The Mortgagee makes no representations concerning the condition of the Mortgaged Premises or its compliance with applicable zoning, building, sanitary or other state and/or municipal regulations. TERMS OF SALE: TEN THOUSAND DOLLARS ($10,000.00) will be required to be paid in cash, certified or bank check with no intervening endorsements at the time and place of sale. If the second highest bidder declines to purchase the Mortgaged Premises, the Mortgagee reserves the right to purchase the within described property at the amount bid by the second highest bidder. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale.
