NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Premises: 254 Eleanor Road, Pittsfield, MA 01201 By virtue and in execution of the Power of Sale contained in a certain mortgage given by Kevin Robert Jagiello a/k/a Kevin Jagiello to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Academy Mortgage Corporation, and now held by PennyMac Loan Services, LLC, said mortgage dated November 10, 2022 and filed in the Berkshire (Middle District) Registry District of the Land Court as Document No.: 43601 and noted on Certificate of Title No.: 8757,said mortgage was assigned from Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Academy Mortgage Corporation to PennyMac Loan Services, LLC by assignment dated September 26, 2023 and filed with Berkshire (Middle District) Registry District of the Land Court as Document No.:44022 and noted on Certificate of Title No.: 8757; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on February 3, 2026 at 11:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit: That certain parcel of land situate in Pittsfield in the County of Berkshire and Commonwealth of Massachusetts, bounded and described as follows: EASTERLY by Eleanor Road, 93.70 feet; NORTHERLY by Lot 109 as shown on the Plan hereinafter mentioned, 223.44 feet; WESTERLY by land of Thomas Tierney as shown on said Plan, 93.70 feet; SOUTHERLY by Lot 111 as shown on said Plan, 223.44 feet. Said Parcel being Lot 110 on Plan 2980-R. All of said boundaries are determined by the Court to be located as shown on Plan 2980-R, drawn by J. R. Carroll, Engineer, dated January 15, 1945, as approved by the Court, filed in the Land Registration Office, a copy of a portion of which is filed with Certificate 1915. Said Parcel is subject to the following restrictions: 1. That no building shall be erected on said premises, any part of which, exclusive of piazzas, porticoes, or any other unenclosed projections, shall be within 40 feet of the nearer line of Eleanor Road as shown on said Plan. 2. That only one single family dwelling house costing not less than $5,000.00, and a garage for not more than two cars for private use, and no portion of any other dwelling house or garage, shall be erected on said Lot. 3. That no manufacturing, commercial, noxious or illegal occupation, trade or employment shall be conducted thereon. Being the same premises conveyed to Patricia Ann Gaynor, a/k/a Patricia Gagner-Franck, a/k/a Patricia Ann Franck, by deed of Raymond P. Gaynor, said deed dated August 8, 1985 and recorded with the Land Court Department of the Berkshire Middle District Registry of Deeds, thereby canceling Certificate No. 4518 and creating transfer Certificate No. 5609, Document No. 19061. The aforementioned Patricia Ann Franck deceased on June 6,2019. For title, see Berkshire Probate Court Docket No. BE20P0009EA. Being the same premise conveyed to the mortgagor by Deed of Nicole Gaynor Personal Representative of the Estate of Patricia Gaynor dated November 7th, 2022 creating Certificate 8757 in Book 44 Page 91. The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. For Mortgagor's Title see deed dated November 7, 2022 and registered with the Berkshire (Middle District) Registry District of the Land Court as Document No.:43600 and noted on Certificate of Title No.: 8757. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale. Other terms to be announced at the sale.
