MORTGAGEE'S NOTICE OF SALE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Robert E. Deubel to 1st Mariner Bank dated January 26, 2010, recorded with Berkshire Middle Registry of Deeds in Book 4481, Page 224, which mortgage was assigned to MetLife Home Loans, a division of MetLife Bank, N.A. by Assignment dated January 26, 2010, recorded in Book 4726 Page 149; further assigned Nationstar Mortgage LLC by Assignment dated October 11, 2012, recorded in Book 5063, Page 57; further assigned to The Secretary of Housing and Urban Development by Assignment dated January 15, 2016, recorded in Book 5708, Page 269; further assigned to Wilmington Savings Fund Society, FSB, Not in its Individual Capacity but Solely as Trustee of Reliant Trust by Assignment dated November 4, 2022, recorded in Book 7332, Page 11; and further assigned to Wilmington Savings Fund Society, FSB, as Owner Trustee of the Residential Credit Opportunities Fund X-A by Assignment dated January 23, 2025, recorded in Book 7776, Page 315, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 AM, on the 6th day of February, 2026 at the mortgaged premises described and known as 88 Stonehouse Road, Washington, Massachusetts described in said mortgage, to wit: All that certain parcel of land situated in County of Berkshire, Town of Washington, Commonwealth of Massachusetts, being bounded and described as follows: Beginning at a point in the Westerly line of Route 8, so-called, where said Westerly line intersects the Southerly line of Stone House Road, so-called; thence Southerly in the said Westerly line of Route 8, 63 rods, more or less to a point; thence Westerly on land now or formerly of one Sears, land now or formerly of one Little, and now or formerly of one Campbell, 177 rods more or less, crossing Lover's Lane, so- called, to an iron pin at the Southwest corner of the within described property; thence Northerly along the line of land now or formerly of Peer, 100 rods, more or less, to an iron pin at the Northwest corner of the within described property; thence Easterly, Southerly, and again Easterly along the line of land now or formerly of one Simmons the following three courses: Easterly 80 rods, more or less, to an iron pin; Southerly 40 rods, more or less, to an iron pin; Easterly, 70 rods, more or less, to an iron pin, which iron pin is on the Westerly side of Stone House Road, so-called, thence following Stone House Road Southerly and Easterly crossing Lover's Lane, so-called, 70 rods, more or less, to the place of beginning. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale date. The Mortgagee further reserves the right to open the bidding at the time, date and place appointed for sale, and if no bids are received, or the bids received are deemed unacceptable to Mortgagee, to postpone the sale to a later date by public proclamation. Said premises will be sold subject to and with the benefit of all restrictions, easements, improvements, outstanding tax titles, mortgages, liens, rights of tenants and parties in possession, unpaid taxes, municipal liens and other public taxes, assessments or liens, having priority over the mortgage described herein, if any. In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with Mortgagee's attorneys the amount of the required deposit as set forth herein within three (3) business days after written notice of default of the previous highest bidder and title shall be conveyed to said second highest bidder within twenty (20) days of said written notice.
