MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain Mortgage dated January 18, 2008 from Louise M. Shuttleworth to Chase Bank USA, N.A. recorded with Berkshire County (Middle District) Registry of Deeds in Book 3977, Page 20, as affected by modification agreement recorded in Book 5935, Page 116, the undersigned U.S. Bank National Association as Legal Title Trustee for Truman 2016 SC6 Title Trust being the present holder of said mortgage by Assignment dated August 11, 2016 from Chase Bank USA, N.A. to JPMorgan Chase Bank, National Association recorded in Book 5799, Page 152, and Assignment dated August 15, 2019 from JPMorgan Chase Bank, National Association to U.S. Bank National Association as Legal Title Trustee for Truman 2016 SC6 Title Trust recorded in Book 6481, Page 253, for breach of the conditions of said Mortgage and for the purpose of foreclosing the same will be sold at Public Auction at: 11:00 A.M. on Thursday, February 25, 2021 upon the hereinafter-described premises, known as and numbered as 17-19 Main Street, Hinsdale, Berkshire County, Massachusetts, all and singularly the premises described in said mortgage, to wit: Beginning at the highway running from Charles H. Plunkett's store to the Western Railroad Depot at the northeast corner of Edward L. Nash's land, now or formerly; thence westerly by said Nash's north line to lands of the Western Railroad Corporation; thence northerly on the east line of said Railroad to lands of Martin Livermore, now or formerly, and parallel with the said south line of said highway; thence southerly by said highway to the place of beginning. Being the same premises conveyed by Shirley Walsh, Administratrix of the Estate of Laura D. Mosegard and Helene R. Trombly to a Carl R. Mosegard and Margaret B. Mosegard, which deed is dated January 19, 1989 and recorded in Berkshire Middle District Registry of Deeds in Book 1259, Page 78c. Also being the same premises conveyed by Carl R. Mosegard to Carl R. Mosegard and Margaret B. Mosegard, by deed February 6, 1989 and recorded in said Registry in Book 1261, Page 96c. The grantors derive their title from the Estate of Carl R. Mosegard (See Berkshire Probate Court Docket #92-PD-496EF1). Being the same premises conveyed to Louise A. Shuttleworth by deed of Shirley M. Walsh and Carl L. Mosegard dated May 17, 1993 recorded June 1, 1993 in the Berkshire Middle Registry of Deeds in Book 1402, Page 57. The above-described premises shall be sold subject to all easements, restrictions, municipal or other public taxes, assessments, liens or claims in the nature of liens, outstanding tax titles, building, zoning and other land use laws and all permits and approvals issued pursuant thereto, including, without limitation, orders of conditions, and existing encumbrances of record created prior to said Mortgage, if there be any. Said premises are to be sold subject to the right of redemption of the United States of America, if any there be. TERMS OF SALE: The highest bidder shall be required to make a deposit of $10,000.00 to the holder of said Mortgage, in cash or by certified or bank cashier's check at the time and place of said sale of said premises. The balance of the purchase price is to be paid to said holder in cash, by certified check or bank cashier's check, and thereupon the deed shall be delivered, in thirty (30) days from the date of sale at the firm of Cunningham, Machanic, Cetlin, Johnson, Harney & Tenney, LLP, Attorneys for said holder, 220 North Main Street, Suite 301, Natick, Massachusetts. The successful bidder shall be required to sign a Memorandum of Terms of Sale. The description of the premises contained in said Mortgage shall control in the event of an error in publication.
