Notice of License Application pursuant to M.G.L. Chapter 91 Application Number 25-WW01-0120-APP Applicant: Lake Buel Restoration Preservation District Project Location:86-Acre Area within Lake Buel, Waters of Lake Buel, Monterey and New Marlborough, Berkshire County Notification Date: September 30, 2025 Public Comments Deadline:October 30, 2025 Public Notice is hereby given of the Chapter 91 License Application by Lake Buel Restoration Preservation District for the following activities associated with the implementation of the Lake Buel Aquatic Plant Management Plan: improvement dredging/mechanical harvesting aquatic plants including but not limited to diver assisted suction harvesting, installation of benthic barriers over a maximum area of 1 acre, and up to 1.2 feet annual drawdown within an 86-acre area of waters of Lake Buel,in Monterey and New Marlborough, Berkshire County. The license is proposed to be issued for a 15-year term. The proposed project has preliminarily been determined to be a Water-Dependent Use. The Department will consider all written comments on this Application received by October 30, 2025 (Public Comments Deadline). Failure of any aggrieved person or group of ten (10) citizens or more to submit written comments to the Waterways Regulation Program by the Public Comments Deadline will result in the waiver of any right to an adjudicatory hearing in accordance with 310 CMR 9.13(4)(c). The group of citizens must include at least five (5) citizens who are residents of the municipality in which the proposed project is located. A public hearing may be held at the request of the Municipal Official.
