Ads for Mortgagee's Sale of Real Estate (October 16, 2025) in the Berkshires


MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by KEVIN D. SARGENT to GREYLOCK FEDERAL CREDIT UNION, dated July 18, 2008, and recorded on July 18, 2008, with the Berkshire Middle District Registry of Deeds in Book 4100, Page 226, of which mortgage the undersigned is the present holder, for breach of the conditions of the said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 11:00 a.m. on the Sixteenth (16th) day of October, 2025, at the mortgaged premises described below, to wit, 310 Hinsdale Road, Dalton, Massachusetts, all and singular, the premises in said Dalton, Berkshire County, Massachusetts, described in said Mortgage, to wit: Parcel One: Beginning at a Massachusetts Highway Monument set in the easterly line of Massachusetts Route No. 8, sometimes called Water Street, said monument being opposite Station 145 + 84.83 on the 1925 layout of said state highway; running thence South 17 degrees 22 minutes 29 seconds East along the easterly line of said state highway known as Water Street a distance of fifty-eight and eighty-four hundredths (58.84) feet to an iron pipe set at the northwesterly corner of a parcel of land conveyed by George J. Rudin and Betty B. Rudin to William O. Streibel and Vera Engleson Streibel by deed dated November 14, 1952, and recorded in the Berkshire Middle District registry of Deeds in Book 591, Page 245; running thence North 67 degrees 1 minute 3 seconds East along the northerly line of said land so conveyed to said Streibel a distance of two hundred forty and sixty-three hundredths (240.63) feet to an iron pipe set in a stone wall marking the supposed southwesterly line of Fox Road, so-called; running thence northwesterly along said supposed southwesterly line of Fox Road about sixty-seven (67) feet to an iron pipe set in said stone wall; running thence South 67 degrees 1 minutes 3 seconds West along land formerly of Crane & Co., Inc., being parallel with the second course above described a distance of one hundred sixty-four and thirty-three hundredths (164.33) feet to an iron pipe; running thence South 70 degrees 11 minutes 4 seconds West, along a course at right angles to said Water Street, a distance of thirty-five (35) feet to the place of beginning. Containing twelve thousand four hundred thirty-two (12,432) square feet, more or less. Being the same premises conveyed to the grantors herein by deed of Clarence E. Warren and Esther F. Warren dated June 12, 1963, and recorded in the Berkshire Middle District Registry of Deeds in Book 764, Page 107. Parcel Two Beginning at a point marked by a Massachusetts Highway bound set opposite Station 145 + 84.83 in the easterly line of the 1925 Commonwealth of Mass. Layout of Route 8, known locally as Water Street, the record plan being recorded in the Berkshire Middle District Registry of Deeds in Drawer 133, said Bound also marks the northwesterly corner of a parcel of land conveyed by The Crane & Co. Fund to Clarence E. Warren and Esther F. Warren by deed dated February 16, 1962, and recorded in the said Registry of Deeds in Book 740, Page 151 (being Parcel One above described); running thence North 19 degrees 48 minutes 56 seconds West along the said easterly line of Mass. Route 8, known locally as Water Street, a distance of 36.14 feet to an iron pipe; running thence North 67 degrees 03 minutes 16 seconds East along remaining land formerly of Crane & Co., Inc. a distance of 173.01 feet to an iron pipe set in the supposed southwesterly line of fox Road; running thence South 55 degrees 22 minutes 07 seconds East along the said supposed southwesterly line of Fox Road a distance of 45.05 feet to an iron pipe set in a stone wall, which iron pipe marks the northeasterly corner of land conveyed by The Crane & Co. Fund to Clarence E. Warren and Esther F. Warren by deed referred to above; running thence South 67 degrees 03 minutes 16 seconds West along the northerly line of land formerly of Clarence E. Warren and Esther F. Warren (the same being Parcel One above) a distance of 164.23 feet to an iron pipe marking an angle in said line; running thence South 70 degrees 13 minutes 52 seconds West a distance of 34.96 feet to the place of beginning. Bearings used in the above-described parcel of land are consistent with the bearings used by the Commonwealth of Massachusetts Department of Public Works shown on the record plan for the 1925 layout of Route 8 referred to above. The above-described parcel of land contains 7,043 square feet and is further shown on a survey entitled "Survey of Land in Dalton, Mass., Being Conveyed by Crane & Co., Inc. To Ward C. Warren and Nancy L. Warren, Scale: 1" = 40', Nov. 2, 1976, John J. Unwin, Reg. Land Surveyor", a copy of which is attached to the deed from Benjamin J. Sullivan, Thomas J. Fahey, and Stephen H. Wismer, Trustees of The Crane & Co. Fund to Ward C. Warren and Nancy L. Warren recorded in the Berkshire Middle District Registry of Deeds in Book 985, Page 480. The above-described parcel is subject to the restriction that no well shall be driven, drilled, dug or maintained on the premises without the written permission of Crane & Co., Inc., it successors or assigns having first been obtained, set forth in an Agreement recorded in said Registry of Deeds in Book 1017, Page 212. Being the same premises conveyed to the grantors herein by said deed of Benajamin J. Sullivan, Thomas J. Fahey, and Stephen H. Wismer, Trustees of The Crane & Co. Fund dated January 25, 1977, and recorded in the Berkshire Middle District Registry of Deeds in Book 985, Page 480. Being the same premises conveyed to the Mortgagors herein by deed of Ward C. Warren, dated July 18, 2008 and recorded immediately prior thereto in the Berkshire Middle District Registry of Deeds. No Mortgage Broker or Originator was used in this transaction. Said premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, prior liens, mortgages and other enforceable encumbrances of record having priority over the mortgage described herein, and subject to, and with the benefit of, all easements, restrictions, improvements, reservations and conditions of record, and all tenancies and/or rights of parties in possession, including rights or claims to personal property installed by tenants or former tenants now located on the premises. It shall be the bidder's sole responsibility to ascertain all items described in this paragraph and no representations are made concerning compliance with applicable zoning, building, sanitary or other state and/or municipal laws, ordinances or regulations.
