You are receiving this notification because you have been identified as the owner of land abutting another parcel of land for which certain activities are proposed. Those activities require a permit under the Massachusetts Wetlands Protection Act (M.G.L. c. 131, 40) . In accordance with the second paragraph of the Massachusetts Wetlands Protection Act, and 310 CMR 10.05( 4) ( a) of the Wetlands Regulations, you are hereby notified that: A. A request for an amendment to the drawdown Order of Conditions Special Conditions for NOI filing #230-0358 was made to the Monterey Conservation Commission on 8/28/2025 seeking permission to alter an area subject to protection under M.G.L. c. 131 40. The following i s a description of the proposed activity/activities: Increase the drawdown to up to 6 ft below full pool elevation, with an earlier drawdown start date and eirlier refill initiation date. For more specific details please refer to the letter of request delivered to the conservation commission. B. The name of the applicant i s: Town of Monterey, Selectboard Chair. C. The address of the land where the activity i s proposed i s: Lake Garfield at Tyringham Road and Beartown Mountain Road Dam, Monterey, MA D. Copies of the Notice of Intent may be examined or obtained at the office of the Monterey Conservation Commission, located at 435 Main Rd, P.O. Box 308, Monterey, MA 01245. E. The regular business hours of the Commission are the second Thursday of each month from 3:00-4:30PM, and the Commission may be reached at (413) 528-1443 ( ext. 230) . F. Copies of the Notice of Intent may be obtained from the applicant, Town of Monterey. An administrative fee may be applied for providing copies of the NOI and proposed amendments to the Order of Conditions. G. Information regarding the date, time, and location of the public hearing regarding the request for amendment may be obtained from the Monterey Conservation Commission. Notice of the public hearing will be published at least five business days in advance, in the Berkshire Eagle newspaper. Notification provided pursuant to the above requirement does not automatically confer standing to the recipient to request Departmental Action for the underlying matter.
