COMMONWEALTH OF MASSACHUSETTS The Trial Court Berkshire Division Probate and Family Court Department Docket No. BE25E0010 TO: Stephen Haile, of Pittsfield, Massachusetts and all other persons interested; A Petition for Partition, dated April 4, 2025 and filed May 30, 2025, has been presented to said Court by Timothy Haile of Pittsfield, Massachusetts, representing that he holds as tenant in common an undivided part or share in certain real estate situate in Pittsfield, Berkshire County, Massachusetts, and described as follows: (Locus of real estate: 68 Lakeway Drive, Pittsfield, Massachusetts) Three certain lots or parcels of land situated on the north side of Lakeway Drive and shown as lots numbered one (1), twenty-two (22) and twenty-three (23) of Plan of J. B. Deane's Building Lots, dated June 1893, G. A. Murdock, Surveyor, recorded in the Berkshire Middle District Registry of Deeds at said Pittsfield in Book 309, Page 645. Said three lots together are 77 feet wide and 288.75 feet deep, containing approximately 22,233 3?4 square feet or about 0.509 acres. Being the same premises conveyed to Moses H. Haile, Jr. and Joanne E. Haile by deed recorded. in the Berkshire Middle District Registry of Deeds in Book 1010, Page 586 on September 28, 1978. 65C Affidavit for Joanne Haile recorded in Book 7712, Page 231 on October 17, 2024; Death Certificate for Joanne Haile recorded in Book 7712, Page 234 on October 17, 2024; 65C Affidavit for Moses Haile recorded in Book 7712, Page 237 on October 17, 2024; Death Certificate for Moses Haile recorded in Book 7712, Page 240 on October 17, 2024. Being all and the same premises conveyed to Timothy Haile and Stephen Haile by deed of distribution by Alan J. Righi as the Special Personal Representative of the Estate of Moses H. Haile, Jr., dated November 26, 2024 and recorded in the Berkshire Middle District Registry of Deeds on November 26, 2024 at Book 7738, Page 174. And setting forth that the petitioner wishes to hold said real estate in severalty; and further that the petitioner desires that all of said land may be sold at private sale for not less than $138,600.00 and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition of all, or any part of said land which the Court finds cannot be advantageously divided at private sale or public auction; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 28th day of July, 2025, the return day of this citation.
