Rathbun of Florida, Massachusetts, and all other persons interested; A petition, dated October 1, 2021 and filed February 8, 2022, has been presented to said Court by Paul D. Thompson, representing that he holds as joint tenant a fifty (50%) per cent share in certain real estate situate in Florida, Berkshire County, Massachusetts and briefly described as follows: Beginning at a point on the northerly side of Mohawk Trail at the southeasterly corner of land now or formerly of Bernard A. Roy, et ux; Thence northerly along the easterly line of land now or formerly of said Bernard A. Roy, four hundred fifty (450) feet; Thence easterly and parallel with the northerly line of the Mohawk Trail, two hundred twenty five (225) feet; Thence southerly and parallel with the easterly line of land now or formerly of Bernard A. Roy, et ux four hundred fifty (450) feet; Thence westerly along the northerly line of the Mohawk Trail, two hundred twenty five (225) feet to the place of beginning. Being the same premises conveyed to Rose M. Rathbun by deed dated July 6, 2012 and recorded with the Berkshire North Registry of Deeds, Book 1490, Page 991. And setting forth that he desires that all of said land may be sold at private sale for not less than One Hundred Sixty-one Thousand and No/100 Dollars ($161,000.00) and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided either at private sale or public auction, and be ordered to distribute and pay over the net proceeds thereof in such manner as to make the partition just and equal. And further, that a set off of the proceeds be made to either party for compensation for any improvements and the payment of all reasonable expenses incurred for the property and that an award be made to Petitioner for costs and expenses incurred to prepare and prosecute this action. If you desire to object thereto, you or your attorney must file a written appearance in said Court at Pittsfield before ten o'clock in the forenoon on the 21st day of July, 2025, the return day of this citation.
