MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Jonathan G. Seward and Jamie L. Seward to Mortgage Electronic Registration Systems, Inc., as nominee for Embrace Home Loans, Inc., its successors and assigns, dated January 18, 2012 and recorded with the Berkshire County (Southern District) Registry of Deeds at Book 2096, Page 54, subsequently assigned to Wells Fargo Bank, N.A. by Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Embrace Home Loans, Incorporated, its successors and assigns by assignment recorded in said Berkshire County (Southern District) Registry of Deeds at Book 2594, Page 190, subsequently assigned to Nationstar Mortgage LLC, its successors and assigns by Wells Fargo Bank, N.A. by assignment recorded in said Berkshire County (Southern District) Registry of Deeds at Book 2891, Page 183 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 1:00 PM on June 26, 2025 at 625 Salisbury Road, Sheffield, MA, all and singular the premises described in said Mortgage, to wit: The land located in the Town of Sheffield, County of Berkshire and Commonwealth of Massachusetts, bounded and described as follows: Beginning at an iron pipe set in the assumed southerly sideline of Salisbury Road, said pipe being at the northeast corner of one Lamanno, now or formerly, and the northwest corner of the parcel herein conveyed. Thence the following three courses and distances along the southerly sideline of Salisbury Road: North 55 00' 31" east 62.24 feet to a point computed; Thence a curve to the right having a radius of 267.23 feet and a length of 173.62 feet to a point computed; Thence south 87 45' 58" east 292.02 feet to an iron pipe set in the northeasterly corner of the parcel herein conveyed and the northwesterly corner of Lot 2A as shown on the plan hereinafter referred. Thence the following two courses and distances along Lot 2A: South 12 31' 42" west 421.70 feet to an iron pipe; South 87 45' 58" east 210.00 feet to an iron pipe, said pipe being in the line of land of one Cartinelli, now or formerly; Thence along Cartinelli land south 12 31' 42" west 233.52 feet to an iron pipe set, said pipe being in the southeast corner of the parcel herein conveyed; Thence the following two courses and distances along other land of Cartinelli: South 85 41' 01" west 9.19 feet to an iron pipe; Thence north 86 37' 53" west 365.10 feet to an iron pipe, said pipe being the southwesterly corner of the parcel herein described; Thence north 19 52' 36" west 589.77 feet along land of one Lamanno, now or formerly, to an iron pipe set, said pipe being the point and place of beginning. Meaning and intending to convey and hereby conveying all of Lot 2B as shown on the plan entitled "Plan of Land Surveyed for Joseph Seward and Maureen Seward in Sheffield Massachusetts May - 2000 Scale 1" = 80' Kelly-Granger-Parsons and Associates, Inc. Great Barrington, Mass.", said plan recorded in the Southern Berkshire Registry of Deeds in Map Plat K-109. LOCUS: 625 SALISBURY ROAD, TOWN OF SHEFFIELD, BERKSHIRE COUNTY, MA. Being the same property conveyed from Edward G. McCormick to Jonathan G. Seward by deed recorded September 12, 2007 in Book 1796, page 130 in the registrar's office of Berkshire County. Parcel ID #: 267/017.0-0002-0006.J Block: Lot: The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney's fees and costs. TERMS OF SALE: A deposit of TEN THOUSAND DOLLARS AND 00 CENTS ($10,000.00) in the form of a certified check, bank treasurer's check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer's check or other check satisfactory to Mortgagee's attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid.
