NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Kyle M. Ruebesam to Mortgage Electronic Registration Systems, Inc., as nominee for Academy Mortgage Corporation, dated January 11, 2018 and recorded in the Berkshire County (Northern District) Registry of Deeds in Book 1645, Page 543, of which mortgage the undersigned is the present holder, by assignment from: Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Academy Mortgage Corporation, its successors and assigns to PennyMac Loan Services, LLC, recorded on February 14, 2025, in Book No. 1879, at Page 634 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 3:00 PM on July 2, 2025, on the mortgaged premises located at 4 Kerr Avenue, Adams, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, TO WIT: Beginning at an iron pin standing at the southwest corner of the house lot formerly owned by William E. Krause, now supposed to be owned by one Adam, which point is also on the easterly line of a new street known as Kerr Avenue; Thence south 15 west 101 feet to the northwest corner of the house lot of Robert Morton; Thence turning to the left and running south 73 50' east to the westerly line of land of the Renfrew Manufacturing Company; Thence north 53 15' east to land of the Inhabitants of the Town of Adams, known as the Renfrew School lot, being the southeast corner of said lot; Thence turning to the left and running north 73 50' west in the south line of said Renfrew School lot and Krause lot to Kerr Street, which is the point or place of beginning. It is agreed and understood herein that the east line of the premises herein described is the line as established by quit-claim deeds by the Renfrew Manufacturing Company to Cyril Meyette and Annie Meyette and from said Cyril Meyette and Annie Meyette to the Renfrew Manufacturing Company. Said quit-claim deeds are dated October 3, 1921, and recorded in the Northern Berkshire Registry of Deeds, to which record reference is hereby made for a more complete description of said easterly line. Together with the conditions, rights and reservations set forth in the deed of Cyril Meyette and Annie Meyette to Jan Czaja and Weronika Czaja dated March 28, 1925 and recorded in said Registry at Book 371 Page 337. Subject to Notice of the Adams Fire District dated September 16, 1965 and recorded in said Registry at Book 596, Page 327. For mortgagor's(s') title see deed recorded with Berkshire County (Northern District) Registry of Deeds in Book 1645, Page 540. These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. TERMS OF SALE: A deposit of Five Thousand ($5,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
