MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by CRYSTAL M. BRADLEY to ADAMS COMMUNITY BANK, dated March 1, 2022, and recorded on March 8, 2022, with the Berkshire Middle District Registry of Deeds in Book 7142, Page 203, of which mortgage the undersigned is the present holder, for breach of the conditions of the said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 11:00 a.m. on the Twenty-sixth (26th) day of June, 2025, at the mortgaged premises described below, to wit, 28 Jayne Avenue, Pittsfield, Massachusetts, all and singular, the premises in said Pittsfield, Berkshire County, Massachusetts, described in said Mortgage, to wit: Lot No. 407, as shown on a plan of lots entitled, "Building Lot Plan No. 9, Laid out for Delalba Realty, Inc., Pittsfield, Massachusetts, Scale: 1 in. - 60 ft., April 7, 1960, Robert B. Deloye, Engineer," which plan was approved by the Planning Board of the City of Pittsfield on February 1, 1961 and a copy of which plan is filed in the Berkshire Middle District Registry in Book 417E, Page 121. Said Lot No. 407 is more particularly described as follows: Beginning at a point in the northerly line of Jayne Avenue at the southeasterly corner of the lot to be conveyed; thence northerly and along the westerly boundary of Lot No. 405 as shown on said plan of lots 126.18 feet to the northeasterly corner of the lot to be conveyed; thence westerly parallel to said northerly line of Jayne Avenue and along land now or formerly of Delalba Realty, Inc. 83.81 feet to the northwesterly corner of the lot to be conveyed; thence southerly and along the easterly line of Lot No. 409 as shown on said plan of lots 126.18 feet to a point in the northerly line of Jayne Avenue, being the southwesterly corner of the lot to be conveyed; thence easterly along said northerly line of Jayne Avenue 83.81 feet to the point and place of beginning. Said lot is subject to an easement given by Wahconah Realty, Inc., to Western Massachusetts Electric Company and New England Telephone and Telegraph Company by instrument dated July 6, 1961 and recorded in said Registry of Deeds in Book 725, Page 177. Said lot is further subject to a drain easement along the easterly 71/2 feet of said lot, as shown on the aforesaid plan. Meaning and intending to convey and hereby conveying in mortgage, all and singular, the same premises conveyed to the grantor herein, Crystal M. Bradley, by deed of Nicholaus S. Bradley and Crystal M. Bradley dated March 1, 2022 and to be recorded concurrently herewith in the Middle Berkshire Registry of Deeds; and being the same premises conveyed to the said Nicholaus S. Bradley and Crystal M. Bradley by deed of Brian L. Sperling and Judith B. Sperling, a/k/a Judith D. Sperling, dated June 1, 2019 and recorded with said Registry of Deeds in Book 6445, Page 222. Said premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, prior liens, mortgages and other enforceable encumbrances of record having priority over the mortgage described herein, and subject to, and with the benefit of, all easements, restrictions, improvements, reservations and conditions of record, and all tenancies and/or rights of parties in possession, including rights or claims to personal property installed by tenants or former tenants now located on the premises.
