NOTICE OF CITY OF NORTH ADAMS'S ELECTION TO SELL REAL PROPERTY PURSUANT TO M.G.L. c. 60, s. 64A(a) The former owner(s) and former legal interest holder(s) of the below referenced properties are hereby notified of the City of North Adams's election to sell the following parcels located within the City of North Adams (the "Properties") pursuant to M.G.L. c. 60, 64A(a), amended by the Acts of 2024, Chapter 140 and effective November 1, 2024: PARCEL I: Land in said North Adams, with the buildings thereon, at 124 Church St., shown as Parcel 118 on Assessors' Map 152, described in Berkshire No. Dist. Deeds, B. 877, P. 1021. The City of North Adams took said property for non-payment for fiscal year 2016 real estate taxes through a tax taking made on July 7, 2017 and recorded on July 7, 2017 in book 1628, page 727. PARCEL II: Land in said North Adams on Arnold Pl., shown as Parcel 121 on Assessors' Map 152, described in Berkshire No. Dist. Deeds, B. 960, P. 142. The City of North Adams took said property for non-payment for fiscal year 2016 real estate taxes through a tax taking made on July 7, 2017 and recorded on July 7, 2017 in book 1628, page 746. PARCEL III: Land in said North Adams, with the buildings thereon, at 130 Church St., shown as Parcel 117 on Assessors' Map 152, described in Berkshire No. Dist. Deeds, B. 1358, P. 224. The City of North Adams took said property for non-payment for fiscal year 2017 real estate taxes through a tax taking made on June 27, 2018 and recorded on June 28, 2018 in book 1657, page 998. PARCEL IV: Land in said North Adams, with the buildings thereon, at 116 Church St., shown as Parcel 119 on Assessors' Map 152, described in Berkshire No. Dist. Deeds, B. 1351, P. 492. The City of North Adams took said property for non-payment for fiscal year 2014 real estate taxes through a tax taking made on May 21, 2015 and recorded on May 21, 2015 in book 1566, page 1092. On September 16, 2021 the City of North Adams filed a complaint in the Massachusetts Land Court against FRANKLIN E. PERRAS to foreclose the right of redemption under said tax takings pursuant to M.G.L. c. 60, 65, docket no. 21 TL 000926. On February 12, 2025, the Court issued a judgment foreclosing the right of redemption and vesting title (ownership) to the properties in the City of North Adams. Said judgment was recorded on March 3, 2025 in book 1880, page 925. The following is a summary of your rights and the procedures for claiming excess equity pursuant to M.G.L. c. 60, 64A(a): In accordance with the Uniform Procurement Act, M.G.L. c. 30B, the City will engage a real estate agent or broker licensed in the Commonwealth, who does not hold an elected or appointed office and who is not employed by the City, within 180 days from February 12, 2025 to list the Property for sale consistent with M.G.L. c. 60, 64A(c)(1). The percentage of the "excess equity" due to you will be calculated by deducting from the gross sale proceeds of the sale of the Properties: (1) the tax title balances as of the date of the foreclosure judgment of the Land Court, February 12, 2025, (2) any unpaid assessments for unpaid water and sewer charges, property insurance and homeowners' association or condominium fees as of the date of foreclosure, February 12, 2025; and (3) documented post-judgment costs incurred by the City from the sale of the Properties, which pursuant to M.G.L. c. 60, as amended by the Acts of 2024, Chapter 140, include, but are not limited to, broker or real estate agent fees or commissions, listing fees, marketing and advertising costs, legal fees, litigation fees and costs, closing costs, transfer fees, auctioneer fees, notice to property owner, appraisal fees, publication costs, property management, emergency demolition, environmental fees, any and all fees and costs associated with eviction action, and other fees, charges or costs directly or indirectly related to the maintenance, marketing and sale of the property, and any unpaid taxes assessed on the property that have not been added to the tax title account. Pursuant to M.G.L. c. 60, 64A, the City will accept the highest offer for the Properties once it is listed for sale. If the Properties do not sell within 12 months of being listed for sale, the City will initiate an auction of the Properties with the assistance of an auctioneer licensed in the Commonwealth, who does not hold elected or appointed office and is not employed by the City. The City will accept at auction the highest bid which is not less than 2/3 of the appraised value of the Properties and is not made by an individual that holds elected or appointed office or who is employed by the City. If the Properties do not sell at the auction, the City will provide notice of its intention to continue the sale to a future date and its intention not to retain ownership of the Properties. Once the Properties are sold after being listed or at auction, the City will prepare and provide a written notice, itemized accounting setting forth the disposition of proceeds arising from the sale or a report of the appraisal, including, but not limited to the sale price, legal fees, marketing fees, advertising costs, auctioneer fees, advertising costs, appraisal fees and any excess equity due within 30 days of the sale. At that time the City will provide notice with instructions on how to claim any excess equity if any is due. Please contact the following with any questions: David J.
