LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Chantale M. Roy and Kevin M. Roy Jr. to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Academy Mortgage Corporation, its successors and assigns, dated December 9, 2016 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 5874, Page 310 (the "Mortgage") of which mortgage Lakeview Loan Servicing, LLC is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., solely as mortgagee, as nominee for Academy Mortgage Corporation, its successors and assigns to Freedom Mortgage Corporation dated January 30, 2020 and recorded at said Registry of Deeds in Book 6569, Page 347, and Assignment from Freedom Mortgage Corporation to Nationstar Mortgage LLC d/b/a Mr. Cooper dated January 17, 2022 and recorded at said Registry of Deeds in Book 7107, Page 59, and Assignment from Nationstar Mortgage LLC d/b/a Mr. Cooper to Lakeview Loan Servicing, LLC dated March 31, 2022 and recorded at said Registry of Deeds in Book 7161, Page 318, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 1100 South Street, Dalton, MA 01226 will be sold at a Public Auction at 3:00 PM on May 20, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: Beginning at a concrete monument making an angle in the southerly line of South Street which angle is the third from Dalton Division Road; Running thence easterly in the southerly line of South Street 53.52 feet to a point; Thence southerly at right angles 140 feet to a point; Thence westerly at right angles 80 feet to a point; Thence northerly at right angles 143.60 feet to a point in the southerly line of South Street; Thence easterly in said line 26.72 feet to the place of beginning. The following restrictions are hereby imposed on the above-described parcel: 1. Only one single family residence to be erected thereon. 2. No portion of said house, exclusive of unenclosed porches, shall be closer than 40 feet from the southerly line of South Street or closer than 10 feet from either side line. 3. No business or industry shall be conducted on said parcel being hereby conveyed. 4. No livestock or poultry of any type shall be kept on these premises. Together with the right to lay, maintain, repair and remove water pipes through and over the following described land, to wit:- Lot No. 10 on a certain plan known as Green Ridge Park, Inc., dated August 1, 1952, A. J. Kohlhofer, Engineer. Also together with rights and benefits granted to the New Junction Water Co., in an instrument dated October 10, 1952, and recorded in the Berkshire Middle District Registry of Deeds. Being Lot No. 2 on a Plan of Green Ridge park, Section No. 1, laid out by Green Ridge Park, Inc., Dalton, Mass., August 1, 1952, A. J. Kohlhofer, C.E., said Plan being recorded in the Berkshire Middle District Registry of Deeds under date of September 30, 1952, Book 417-B, Page 146. Meaning and intending to convey and hereby expressly conveying, in mortgage, all and singular, the same premises conveyed to the Mortgagors herein by deed of Nicola Sabha dated December 5th , 2016 and recorded in the Berkshire Middle District Registry of Deeds in Book 5874, Page 307. For mortgagor's title see deed recorded with the Berkshire County (Middle District) Registry of Deeds in Book 5874, Page 307. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
