Lapine, representing that he hold as joint tenant an undivided part or share' in certain real estate situate in Adams, Berkshire County, Massachusetts, and described as follows: (Locus of real estate: 233 Columbia Street, Adams, Massachusetts) Beginning at an iron pipe driven into the ground in the apparent easterly line of Columbia Street distance forty-eight (48) feet from the southwest comer and sixty-eight and thirty-five hundredths (68.35) feet from the southeast comer of the house standing on land now or formerly of one Ruebesam, lying northerly of parcel herein described; thence south 85 45' 43" east, seventy-seven (77.0) feet to an iron pipe driven into the ground, distant seventy and seventy-two hundredths (70.72) feet from the southwest comer and fifty-one and eighty-nine hundredths (51.89) feet from the southeast comer of aforesaid house; thence south 15 46' 43" east, thirty-nine and forty-five hundredths (39.45) feet to a monument in line of land now or formerly of the Arnold Print Works; thence south 36 45' 4 7" west along land of aforesaid Arnold Print Works, one hundred thirty--nine and twenty-six hundredths (139.26) feet to a monument; thence continuing along land of said Arnold Print Works south 11 55' 47' west, eighty-seven and twelve hundredths, (87.12) feet to a monument; thence north 75 44' 13" west, thirty-nine and fifty-two hundredths (39.52) feet to a monument in the easterly line of Columbia Street, aforesaid; thence northerly along the apparent east line of said Columbia Street, two hundred thirty-six and forty-one hundredths (236.41) feet to the iron pipe at the point of beginning. The easterly line of aforesaid Columbia Street has not been determined and the grantors intend hereby to convey to the easterly line of aforesaid street wherever said line may be established. Except land taken pursuant to Order of Taking by Commonwealth of Massachusetts dated July 10, 1996 and recorded in Book 919, Page 382 at the Northern Berkshire Registry of Deeds and pursuant to Amended Order of Taking by Commonwealth of Massachusetts dated January 22, 1997 and recorded in Book 929, Page 1100. See Plan recorded in aforesaid registry in Drawer 2, #248. Together with and subject to the terms of a Special Permit issued by the Adams Zoning Board of Appeals, notice of which is dated January 20, 2010 and recorded with the Northern Berkshire Registry of Deeds in Book 1398, Page 674. Being the same premises conveyed to Karl A. Lapine and Christine Haring by deed of Erik R. Pizani and recorded in the Northern Berkshire Registry of Deeds on December 15, 2011 at Book 1462, Page 196. And setting forth that the petitioner desires that all of said land may be sold at private sale for not less than $175,000.00 and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition of all, or any part of said land which the Court finds cannot be advantageously divided at private sale or public auction; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 30th day of May, 2025, the retun day of this citation.
