NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by AJC Makana, LLC to Aldrich Maple, LLC, dated November 14, 2023, and recorded with the Berkshire Southern Registry of Deeds in Book 02870, Page 323, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 55 & 0 Maple Hill Road, West Stockbridge, Berkshire County, Massachusetts 01266, will be sold at Public Auction at 12:00 o'clock P.M. on the 21st day of May 2025 at the mortgaged premises more particularly described below, all and singular the premises described in said mortgage, to wit: PARCEL#1: Being Parcel #1 on said plan entitled "PLAN OF LAND SURVEYED FOR IRWIN and RENEE SHISHKO IN WEST STOCKBRIDGE, MASSACHUSETTS, OCTOBER- 1998, SCALE 1"=150'," PREPARED BY KELLY-GRANGER-PARSONS AND ASSOCIATES, INC, GREAT BARRINGTON, MASS., and recorded on January 26, 1999, with Berkshire Southern District Registry of Deeds in Plat File K-11, which parcel, according to said plan, contains 6.002 acres. Parcel #1 is conveyed with an exclusive and permanent easement running with the land in perpetuity for the benefit of the Grantee, its successors and assigns, to maintain and use the driveway leading to the premises conveyed from Maple Hill Road across Parcel #3 shown on said Plan in the current location depicted on the Plan, for all the usual purposes of a way, including the right to enter with equipment upon those portions of the Parcel #3 as may be reasonable required to maintain, repair, reconstruct, improve (and remove if deemed desirable or necessary by the Grantee, his successors or assigns) said way and such other improvements and structures as may be reasonably necessary for and appurtenant to the Grantee's maintenance and use of the driveway. Parcel #1 is also conveyed with the benefit of the following permanent restrictions, which will run with the land in perpetuity to benefit the Grantee, its successors and assigns, imposed upon other land on said Plan: No structures or other improvements, including without limitation, buildings, driveways, and above-ground utility lines, poles and pipes, will be built within the "no build zone" shown on Parcels #1 and #3 on the Plan, which areas are more particularly described as (i) the area of Parcel #3 between Maple Hill Road and a dotted line labeled "no build zone," and (ii) the area of Parcel#1 between its southeasterly boundary and the dotted line parallel thereto and 100 feet northwesterly thereof labeled "no build zone"; and Each of Parcels #1, #3, #4, and #5, will be used for one single-family dwelling (but no trailers or mobile homes) and appurtenant buildings and structures. PARCEL#2: Being Parcel #2 on said plan entitled "PLAN OF LAND SURVEYED FOR IRWIN and RENEE SHISHKO IN WEST STOCKBRIDGE, MASSACHUSETTS, OCTOBER-1998, SCALE 1"=150', PREPARED BY KELLY-GRANGER-PARSONS AND ASSOCIATES, INC, GREAT BARRINGTON, MASS., and recorded on January 26, 1999, with Berkshire Southern District Registry of Deeds in Plat File K-11, which parcel, according to said plan, contains 62.613 acres. Parcel #2 is conveyed with an exclusive and permanent easement running with the land in perpetuity to benefit the Grantee, its successors and assigns, to maintain and use the driveway leading to the premises conveyed herein from Maple Hill Road across Parcel #3 on said Plan in the current location depicted on the Plan, for all the usual purposes of a way, including the right to enter with equipment upon those portions of the Parcel #3 as may be reasonably required to maintain, repair, reconstruct, improve (and remove if deemed desirable or necessary by the Grantee, bis successors or assigns) said way and such other improvements and structures as may be reasonably necessary for and appurtenant to the Grantee's maintenance and use of the driveway. Parcel #2 is also conveyed with the benefit of the following permanent restrictions, which will run with the land in perpetuity to benefit the Grantee, its successors and assigns, imposed upon other land herein shown on the Plan: No structures or other improvements, including without limitation, buildings, driveways, and above-ground utility lines, poles and pipes, will be built within the "no build zone" shown on Parcels #1 and #3 on the Plan, which areas are more particularly described as (i) the area of Parcel #3 between Maple Hill Road and a dotted line labeled & "no build zone", and (ii) the area of Parcel # 1 between its southeasterly boundary and the dotted line parallel thereto and I00 feet northwesterly thereof labeled "no build zone"; and Each of Parcels #1, #3, #4, and #5, will be used for one single-family dwelling (but no trailers or mobile homes) and appurtenant buildings and structures. Being the same premises conveyed to the Mortgagor herein by deed of Aldrich Maple, LLC recorded in the Berkshire South County Registry of Deeds just prior hereto. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Weicker Law, PLLC, 91 Mill Street, Suite 5, Dracut MA 01826 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control. Other terms, if any, to be announced at the sale.
