NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Howard I. Eisler, a/k/a Howard Eisler, to County Mortgage, LLC, dated August 30, 2021, and recorded with the Berkshire County (Middle District) Registry of Deeds in Book 6999 at Page 196, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 A.M. on the 11th day of April 2025, at 850 Summer Street, Unit M-6, Lee, MA 01238, all and singular the premises described in said mortgage, To wit: Parcel 2, 850 Summer Street, Unit M-6, formerly known as Unit 4, Lee, Massachusetts, owned by Howard Eisler. Unit 4, now known for all purposes as Unit M-6 (the "Unit") at Meadow Wood Condominium, a condominium located in the towns of Lenox and Lee, Berkshire County, Massachusetts, and established by David G. Carver, Trustee of the Scarafoni Associates Nominee Trust pursuant to Massachusetts General Laws Chapter 183A by Master Deed dated October 17, 2010 and recorded in the Berkshire Middle District Registry of Deeds in Book 4827, Page 192 (the "Master Deed"). The Condominium Unit is subject to the provisions of G.L. c. 183A shown on a plan entitled "Meadow Wood Condominium, Summer Street, Laurel Lake Cross Road and route 7, Lee & Lenox" (the "Condominium Site Plan"), recorded in said Registry in Plat J#84. The Unit contains the dimensions shown on the Master Deed and is conveyed together with an undivided 2.994% interest in the common areas and the facilities of the Condominium appurtenant to the Unit as set forth in the Master Deed, and as shown on the Condominium Site Plan. The Unit is conveyed subject to, and with the benefit of the provisions of General Laws, Chapter 183A, the Master Deed and the Meadow Wood Declaration of Trust (the "Declaration") dated October 17, 2011 and recorded with the said Registry of Deeds in Book 4827, Page 218, including the by-laws, obligations to pay common expenses and rules and regulations promulgated thereunder. Subject to all restrictions, easements and other such rights as are contained in the Master Deed. The premises are subject to a first mortgage given by Howard Eisler to MERS, Inc., as nominee for Quicken Loans, Inc., in the original principal amount of $340,000.00, dated August 31, 2018, and recorded at said Registry of Deeds in Book 6267, Page 135; as assigned from MERS, Inc., as nominee for Quicken Loans, Inc., to Rocket Mortgage, LLC f/k/a Quicken Loans LLC dated August 28, 2023 and recorded at the said Registry of Deed in Book 7476, Page 159. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: A deposit of ten thousand dollars ($10,000.00) by certified or bank check will be requiredto be paid by the purchaser at the time and place of sale. The balance is to be paid by wire transfer to Ligris+ Associates, P.C., 1188 Centre Street, Newton, MA 02459 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
