MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Kenneth D. Davis and Linda R. Davis to PNC Mortgage, a division of PNC Bank, National Association, dated August 25, 2014 and recorded with the Berkshire County (Northern District) Registry of Deeds at Book 1547, Page 1087 as affected by a Confirmatory Mortgage recorded on March 16, 2015 in Said Registry of Deeds at Book 1561, Page 971 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 11:00 AM on February 25, 2025 at 19 Fairgrounds Avenue, North Adams, MA, all and singular the premises described in said Mortgage, to wit: The land with any and all buildings thereon situate on the westerly side of Fairgrounds avenue in North Adams, bounded and described as follows: Parcel 1: Beginning at a marble post set in the ground on the westerly side of Fairgrounds Avenue, at the southeasterly corner of lands formerly of C.Q. Richmond et al, and formerly occupied by the Carbon Works; thence running southerly on said last mentioned street about 70 feet to the northerly side of Walden Street, thence running westerly on the northerly side of Walden Street, 4 rods 11 links to an iron pin driven in the ground; thence northerly about 50 feet to an iron pin driven in the ground; thence easterly about 4 rods and 11 links to the place of beginning. Parcel 2: Beginning at the northeasterly corner of land of one Twomey at a stake driven into the ground in the westerly line of Fairgrounds Avenue; thence running westerly along the northerly line of land of said Twomey and land supposedly of one Goodman, formerly of one Higgins, and continuing in the same course, a distance of about 128 feet, more or less, to land of said Goodman, or of the Higgin's estate; thence northerly along the easterly line of land supposedly of said Goodman, or of the Higgin's estate, to the southerly line of land of the Boston & Maine Railroad Company; thence easterly along the southerly line of said land of the Boston & Maine Railroad Company, a distance of 88.3 feet to a stake driven into the ground in the westerly line of said Fairgrounds Avenue; thence southerly along the said westerly line of Fairgrounds Avenue, a distance of about 80 feet to the place of beginning. Excepting that parcel of land conveyed by Daniel D. Twomey and Rose Twomey to John F. McHugo and Anna McHugo by deed dated June 12, 1941 and recorded with the Northern Berkshire Registry of Deeds in Book 426, Page 377. Together with any fee in and to that portion of Fairgrounds Avenue upon which said land abuts, insofar as I have title to said Avenue. Subject to Notice of Decision from the City of North Adams Zoning Board of Appeals to Robert G. Wolfrum and Michelle R. Wolfrum pursuant to document dated June 29, 2000 and recorded in the Northern Berkshire Registry of Deeds in Book 1009, Page 47. Meaning and intending to convey and hereby conveying, all and singular, the same premises conveyed to the Grantor herein by deed of Robert G. Wolfrum dated February 1, 2006, and recorded with the Northern Berkshire Registry of Deeds in book 1237, Page 738. The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney's fees and costs. TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer's check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer's check or other check satisfactory to Mortgagee's attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale.
