NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by KCS Materials LLC, to Certain Lending, Inc., dated August 1, 2021, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1760 at Page 828, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1:00 P.M. on the 13th day of November 2024, at 306 Union Street, North Adams, MA 01247, all and singular the premises described in said mortgage, To wit: The Land referred to herein below is situated in the County of Berkshire, State of Massachusetts, and is described as follows: A parcel of land, with any and all buildings thereon in said North Adams, at 306 Union St,, shown as Parcel 12 on Assessors' Map 108, bounded and described as follows: Beginning at an iron pipe driven in the ground on the southerly side of Union Street, said pipe marking the northwesterly corner of Lot 42 as shown on plan of land entitled "Map Showing Lot 42 and Adjacent Properties;" drawn by William E. Orton, Surveyor, dated March 25, 1961, which plan is on file with the Northern Berkshire Registry of Deeds in Book 240F Page 157; thence running southeasterly a distance of sixty (60) feet to an iron pipe driven in the ground; thence again southeasterly a distance of one hundred three and two tenths (103.2) feet to an iron pipe in the ground, said pipe marking the southwesterly corner of Lot 42 as shown on said plan; thence continuing southeasterly thirty-one (31) feet to an iron pipe; thence turning and running in a southwesterly direction a distance of fifty-seven and eight tenths (57.8) feet to an iron pipe; thence continuing southwesterly, in the same course, a distance of fifty-one (51) feet to an iron pipe in the ground; thence turning and running northwesterly in a straight line a distance of two hundred twenty (220) feet to the southerly line of Union Street; thence running northeasterly along the southerly line of said Street, eighty-six and six hundredth (86.06) feet to the place of beginning. Meaning and intending to convey Lot 41 as shown on said plan. For title see deed recorded at Book 1734, Page 850. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: A deposit of five thousand dollars ($5,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale.
