NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Premises: 14 Summit Avenue, Pittsfield, MA 01201 By virtue and in execution of the Power of Sale contained in a certain mortgage given by Michael J Carnute and Keith J. Carnute to JPMorgan Chase Bank, N.A., and now held by U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for Legacy Mortgage Asset Trust 2017-RPL2, said mortgage dated April 18, 2007 and recorded in the Berkshire County (Middle District) Registry of Deeds in Book 3780, Page 155, as affected by a Loan Modification dated September 1, 2012 and recorded in the Berkshire County (Middle District) Registry of Deeds in Book 5037, Page 58; said mortgage was assigned from JPMorgan Chase Bank, National Association to Federal National Mortgage Association by assignment dated September 11, 2014 and recorded with said Registry of Deedsin Book 5467, Page 176; said mortgage was assigned from Federal National Mortgage Association to MTGLQ Investors, L.P. by assignment dated December 15, 2017 and recorded with said Registry of Deedsin Book 6114, Page 251; said mortgage was assigned from MTGLQ Investors, L.P. to U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for Legacy Mortgage Asset Trust 2017-RPL2 by assignment dated January 8, 2019 and recorded with said Registry of Deedsin Book 6348, Page 51; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on November 14, 2024 at 02:00 PM Local Time upon the premises,all and singular the premises described in said mortgage, to wit: A certain piece or parcel of land situated on the easterly side of Summit Avenue, in said Pittsfield, and being lot numbered thirty-one (31) on Plan of Building Lots of the James Francis Estate, which said plan is recorded in the Berkshire Middle District Registry of Deeds at said Pittsfield in Book 297, Page 660; said lot being sixty-six (66) feet front and rear and one hundred fifteen and five- tenths (115.5) feet deep. The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. For Mortgagor's Title see deed dated April 18, 2007 and recorded in the Berkshire County (Middle District) Registry of Deeds in Book 3780, Page 153. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser.
