Commonwealth of Massachusetts The Trial Court Probate and Family Court Department Berkshire Division Docket No. BE23E0016 TO: Laurie Beliveau of Taunton, Massachusetts; Mary Ann Hopkins of Orlando, Florida and Lisa DeRose of Adams, Massachusetts, and all other persons interested; A Petition for Partition, Dated December 4, 2023 and filed December 11, 2023, has been presented to said Court by Connie J. Devlin of Beverly, Massachusetts "Petitioner", representing that she holds as tenant in common and undivided part or share in certain real estate situated in Adams, Berkshire County, Massachusetts, and described as follows: (Property Location: 17 Morningside Avenue, Adams, MA) Beginning at a point on the southerly line of Richmond Avenue, said point marking the northwest corner of the premises herein conveyed; thence running south 15 30' 39" west, 132 feet to a point; thence running south 74 30' 39" east, 99 feet to a point, marking the southwest corner of land owned by Phillip J. and Elfrieda O'Hagerty; thence running northerly along the land of said O'Hagerty, 132 feet to the southerly bound of said Richmond Avenue; thence running westerly along said Richmond Avenue, 99 feet to the point or place of beginning. Meaning and intending hereby to convey and hereby conveying lots #12 and #46 as shown on a plan of lots entitled "Plan of Building Lots At Morningside, Adams, Mass., Belonging to Mrs. Mary A. Richmond, Surveyed and Drawn by F.S. Smith, C.E. May 8, 1893 - The Lots Not Sold Were Changed From the Original, August 29, 1900"; which plan is recorded in the Northern Berkshire Registry of Deeds, Drawer #2, Plans #19 and #20. Meaning and intending hereby to convey, and hereby conveying, all and the same premises conveyed to us by deed of Nellie Cassidy dated July 30, 1957 and recorded in the Northern Berkshire Registry of Deeds in Book 529, Page 404. Being the same premises described in a deed of Leonard A. Turgeon and Evelyn E. Turgeon to Conrad E. Payette and Marcia J. Payette, as joint tenants with the right of survivorship, dated July 14, 1977, and recorded with Northern Berkshire Registry of Deeds in Book 678, Page 298 Conrad E. Payette predeceased the Decedent. See New York State Department of Health Certificate of Death recorded in Book 919, Page 209. The Decedent died on December 11, 2016. See Berkshire County Probate and Family Court, Docket No. BE17P0018EA and Affidavit under M.G.L c. 65C/14(a), recorded in said Registry herewith. A Deed of Distribution issued on October 28, 2023, and was recorded in said Registry at Book 1839, Page 1006. And setting forth that she desires that all of said land may be sold at private sale for not less than $250,000 and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition of all, or any part of said land which the Court finds cannot be advantageously divided at a private or public sale; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 22nd day of July, 2024, the return day of this citation.
