NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Glenn R. LaBelle to TD Bank, N.A., dated October 17, 2012, recorded or filed at Berkshire County Registry Northern District in Book 1491, Page 823, said mortgage having been assigned to TD Bank, N.A. by Assignment of Mortgage from Mortgage Electronic Registration Systems as nominee for TD Bank, N.A. to TD Bank, N.A. dated September 3, 2019 and recorded or filed at Berkshire North County Registry of Deeds in Book 01692, Page 118, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 2:00 p.m. (ET) on the 6 th day of February, 2024, on the mortgaged premises located at 24 Country Club Avenue, Adams, Massachusetts, all and singular the premises described in said mortgage. The following described real estate situated in County of Berkshire, State of Massachusetts, to wit: The land with any and all buildings thereon situate on the easterly side of County Club Avenue in said Adams, bounded and described as follows: Beginning at an iron pipe driven in the ground in the easterly line of Country Club Avenue, which pipe is 600 feet southerly from the intersection of the easterly line of said Country Club Avenue and the southerly line of a street; Thence S 72 00' E, 120.92 feet to an old iron pin; Thence S 72 10' E, 50.08 feet to an old iron pin in the westerly line of land of the Forest Park Country Club; Thence in the westerly line of said Forest Park Country Club S 20 10' W, 26.00 feet to an iron pin; Thence N 69 50' W, 59.06 feet to an iron pin; Thence S 19 10' W, 5.56 feet to an iron pin; Thence N 71 00' W, 111.50 feet to an iron pin in the easterly line of Country Club Avenue; Thence on the easterly line of Country Club Avenue N 19 20' E, 26.88 feet to the place of beginning. Meaning and intending to convey hereby the northerly portion of land as shown on a plan filed in the Northern Berkshire Registry of Deeds as Plan 106 in Binder 1 entitled "Plan of Land in Adams, Mass. To be conveyed by Chas. A. and Ruth M. Eastwood" surveyed and drawn July 2, 1947 by E.L. Cadigon, registered land surveyor. Subject to the easement to lay and forever maintain and repair a sewer along the course where the same now runs from Lot Number 20 across a portion of Lot Number 21 to Country Club Avenue, which easement is recorded in said Registry in Book 379, Page 213. Together with and subject to rights in a right of way to be used in common by the grantee and Edmund M. Grabicki et ux, and his heirs and assigns forever, more particularly the right to use said right of way lying easterly of point J to be used as foot passage as shown and designated on the aforementioned plan; also subject to the right of Edmund M. Grabicki et ux, and his heirs and assigns forever, to use a strip of land running along the southerly line of the premises hereby conveyed, wide enough for the express purposes of painting, repairing and maintaining the dwelling owned now or formerly by the same Edmund M. Grabicki et ux. Together with the right to erect scaffoldings, or place ladders or other items of a like nature that may be necessary for the said painting, repairing and maintaining of the northerly side of their residence. Subject to the rights of Edmund M. Grabicki et ux, his heirs and assigns, to enter the dwelling for the purposes of repairing and maintaining a sewer line, which branches off from the sewer entering the referred to dwelling and proceeds in a southerly direction to the dwelling now or formerly owned by said Edmund M. Grabicki et ux. Subject to the grantee herein, his heirs and assigns, equally maintaining, repairing and replacing, together with Edmund M. Grabicki et ux, his heirs and assigns, the sewer now running from country club avenue to the dwelling herein conveyed to the grantee to a point where the same branches off to his respective dwelling. Being the same property conveyed to Glenn R. LaBelle, an unmarried person by deed from John A. Socha, an unmarried person recorded 10/17/2012 in Deed Book 1491, Page 819, in the Registry of Deeds Plan for Berkshire County, MA. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: A deposit of five thousand dollars ($5,000.00) by certified or bank check made payable to TD Bank, N.A. will be required to be paid by the purchaser at the time and place of sale. TD reserves the right to reject any and all bids at any time. The balance is to be paid by certified or bank check payable to TD Bank, N.A. c/o Duane Morris LLP, 2 Monument Square, Suite 505, Portland, ME 04101-4097, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
