NOTICE OF INTENT TO REQUEST THE RELEASE OF FUNDS November 1, 2023 Town of Adams, Town Hall - 8 Park Street, Adams, MA 01220 413-743-8300 x130 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Town of Adams. REQUEST FOR RELEASE OF FUNDS On or about November 27, 2023, the Town of Adams will submit a request to the Commonwealth of Massachusetts to release Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following projects: FY2022-23 CDBG - Adams Housing Rehabilitation Program & Route 8 Target Area Repaving and Sidewalk Replacement Project The Adams Housing Rehabilitation Program will rehabilitate up to ten (10) single-family or multifamily residential units and will not increase unit density, change the land, nor increase the footprint of buildings in a floodplain or wetland. It is anticipated that 100% of the program's beneficiaries will be low/moderate income persons. The Route 8 Target Area Repaving and Sidewalk Replacement Project will eliminate blighting conditions by rehabilitating existing pavement and sidewalks in the target area that are in fair or poor condition. Specifically, the project will repave 1,295 linear feet of roadway, replace 1,500 feet of sidewalk, and upgrade six (6) curb ramps to meet ADA standards. Work will take place on Cook, Albert, and Pleasant Streets. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Town of Adams Community Development Department. All comments received by November 22, 2023 will be considered by the Town of Adams prior to authorizing the submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The Town of Adams certifies to the Commonwealth of Massachusetts that the Town and Christine Hoyt, in her capacity as Chairman of the Board of Selectmen, consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Commonwealth's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Adams to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The Commonwealth of Massachusetts will accept objections to its release of funds and the Town of Adams' certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Adams; (b) the Town of Adams has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Commonwealth; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Massachusetts Community Development Block Grant, Department of Housing and Community Development, 100 Cambridge Street, Suite 300, Boston, MA 02114. Potential objectors should contact the Commonwealth to verify the actual last day of the objection period.
