MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by WENDY MARIE RISCH to ADAMS COMMUNITY BANK, dated June 19, 2015, and recorded on June 19, 2015, with the Berkshire Northern District Registry of Deeds in Book 1569, Page 299, of which mortgage the undersigned is the present holder, for breach of the conditions of the said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 11:00 a.m. on the Sixteenth (16th) day of November, 2023, at the mortgaged premises described below, to wit, 35-37 Victory Terrace, Adams, Massachusetts, all and singular, the premises in said Adams, Berkshire County, Massachusetts, described in said Mortgage, to wit: Lots 13 and 14 as shown on a plan entitled "Plan No. 4 Showing Subdivision of Land Belonging to David Richmond," dated January 1903, drawn by C.C. Haskins, C.E. and on file in the Northern Berkshire Registry of Deeds as Plan 84 in Map Drawer 2. MEANING and INTENDING to convey and hereby expressly conveying, in mortgage, all and the same premises conveyed to Wendy Marie Risch by deed of Pamela J. Eastwood, dated June 19, 2015 and recorded June 19, 2015 with the Berkshire Northern District Registry of Deeds simultaneously herewith. Said premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, prior liens, mortgages and other enforceable encumbrances of record having priority over the mortgage described herein, and subject to, and with the benefit of, all easements, restrictions, improvements, reservations and conditions of record, and all tenancies and/or rights of parties in possession, including rights or claims to personal property installed by tenants or former tenants now located on the premises.
