NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by John J. Pollitt Jr. A/K/A John J. Pollitt and Julie J. Pollitt to Beneficial Massachusetts Inc. dated April 25, 2007, recorded at the Berkshire County (Southern District) Registry of Deeds in Book 1765, Page 259; said mortgage was then assigned to U.S. Bank Trust, N.A., as trustee for LSF8 Master Participation Trust by virtue of an assignment dated July 3, 2014, and recorded in Book 2261, Page 78; and further assigned to Wilmington Trust, National Association, not in its individual capacity but solely as Trustee for MFRA Trust 2016-1 by virtue of an assignment dated February 16, 2017, and recorded in Book 2415, Page 341 of which mortgage the undersigned is the present holder for breach of conditions of said mortgage and for the purpose of foreclosing the same will be sold at PUBLIC AUCTION at 10:00 AM on April 13, 2023, on the mortgaged premises. This property has the address of 487 Polikoff Road, Ashley Falls (Sheffield), MA 01222. The entire mortgaged premises, all and singular, the premises as described in said mortgage: Deed Book 663, Page 90: All that certain piece or parcel of land with the improvements thereon and appurtenances thereto belonging, situated easterly of Polikoff Road so-called, in the town of Sheffield, County of Berkshire, and Commonwealth of Massachusetts, more particularly bounded and described as follows: Beginning at an iron rod to be set in the easterly line of Polikoff road, so-called, which point marks the southwesterly corner of the premises herein described and the northwesterly corner of lot #6 as shown on hereinafter referred to map; thence S 82 degrees 01' 13" E 460.00 feet along line of said lot #6 to an iron pipe to be set; thence N 03 degrees 47' 21" E 150.00 feet along line of lands now or formerly of Richard A. Bunce, Sr. and Nancy Bunce to an iron pipe to be set; thence N 82 degrees 01' 13" W 300.00 feet along line of lot #4 as shown on hereinafter referred to map to an iron pipe to be set and in the same course 160 feet to an iron pipe to be set in the northwesterly corner of the parcel herein described; thence S 03 degrees 47' 21" W 150.00 feet along the easterly line of said Polikoff road, so-called, to an iron rod to be set, being the point and place of beginning, containing 1.580 acres of land more or less. Said premises are designated as lot #5 on a map entitled "Lands of Book 610, Page 36 Richard A. and Nancy Bunce St., Town of Sheffield, Berkshire County, Massachusetts, scale 1" = 100'" dated September 2, 1986, William L. Kormanik, P.L.S., Lane Land Surveys, Inc. Sheffield, Mass., recorded in the Southern Berkshire Registry of Deeds in plat file C-63, being all that same land and real estate conveyed to the grantors herein by warranty deed from Richard A. Bunce, Sr. and Nancy Bunce dated August 6, 1987, and recorded in the Southern Berkshire Registry of Deeds in Book 646 at Page 288. Deed Book 862, Page 53: That certain piece or parcel of land, being rectangular in shape and being the northwesterly corner of land of McElhone; and being 12.5 feet in width md 230 feet in length and shown as Parcel A on the following described plan, "map of land of James W. McElhone, Jr. , et al., Polikoff Road, Sheffield, Massachusetts (Book 649, Page 311) scale 1 inch= 30 feet, prepared by Dr. George D. Adotte " excepting therefrom all that certain property known as 12.5 feet wide, 230 feet long, Parcel B "map of land of James W. McElhone, Jr., et al, Polikoff Rd., Sheffield, MA" acquired by James W. McElhone, Jr. by deed dated 08/10/1993 recorded 08/10/1993 in deed volume 862 page 52. Subject to and with the benefit of easements, reservation, restrictions, and taking of record, if any, insofar as the same are now in force and applicable. In the event of any typographical error set forth herein in the legal description of the premises, the description as set forth and contained in the mortgage shall control by reference. Together with all the improvements now or hereafter erected on the property and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock and all fixtures now or hereafter a part of the property. All replacements and additions shall also be covered by this sale. Terms of Sale: Said premises will be sold subject to any and all unpaid taxes and assessments, tax sales, tax titles and other municipal liens and water or sewer liens and State or County transfer fees, if any there are, and TEN THOUSAND DOLLARS ($10,000.00) in cashier's or certified check will be required to be paid by the purchaser at the time and place of the sale as a deposit and the balance in cashier's or certified check will be due in thirty (30) days, at the offices of Doonan, Graves & Longoria, LLC ("DG&L"), time being of the essence.
