NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE PRIVATE Premises: 3650 Jacobs Ladder Road, Becket, Massachusetts By virtue and in execution of the Power of Sale contained in a certain mortgage given by William E. Jefferson and Louise V. Jefferson to MetLife Home Loans, a Division of MetLife Bank, N.A., said mortgage dated April 22, 2011, and recorded in the Berkshire County (Middle District) Registry of Deeds, in Book 4745 at Page 93 and now held by Mortgage Assets Management, LLC by virtue of an assignment from Nationstar Mortgage LLC to Mortgage Assets Management, LLC dated March 1, 2022 and recorded in the Berkshire County (Middle District) Registry of Deeds, in Book 7137 at Page 157, previously assigned by Metlife Home Loans, a division of Metlife Bank, N.A., to Nationstar Mortgage LLC by virtue of an assignment dated August 16, 2012 and recorded in the Berkshire County (Middle District) Registry of Deeds, in Book 5034 at Page 204, for breach of the conditions in said mortgage and for the purpose of foreclosing the same, will be sold at Public Auction on April 4, 2023 at 12:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit: The land situate on the northeasterly side of Route #20 at Greenwater Pond, in Becket, County of Berkshire, Commonwealth of Massachusetts, bounded and described as follows: Beginning at a stone bound set on or near the northeasterly line of the State Highway known as Route #20, one hundred eighty (180) feet, more or less, northwesterly from a westerly corner of land of one Noel, now or formerly; thence N. 69 one hundred (100) feet to an iron pipe; thence in the same course a distance of one hundred five (105) feet, more or less, to a point in the westerly line of said Noel, now or formerly; thence southeasterly in a straight line following said Noel's southwesterly line a distance of one hundred eighty (180) feet, more or less, to a point, it being the southeasterly corner of the parcel being described; thence southwesterly along the northerly line of land of said Noel, now or formerly, a distance of two hundred five (205) feet, more or less, to an iron pipe in or near the northeasterly line of said Route #20, it being the northwesterly corner of land of said Noel, now or formerly, and the southwesterly corner of the parcel being described; thence northwesterly following the northeasterly line of said Route #20 a distance of one hundred eighty (180) feet, more or less, to the place of beginning. Also conveying any rights we may have in and to the land lying between the sideline of the conveyed parcel extending in a generally westerly direction to the low water mark of said Greenwater Pond, but subject to the rights of the public in that portion of the Massachusetts State Highway, known as Route #20, that lies within the above-described parcel. Also reserving the water rights set forth in the deed from Pell H. Holmer and Anna M. Holmer to Arthur L. MacCannell Jr. dated September 10, 1957 and recorded with the Berkshire Middle District Registry of Deeds in Book 662, Page 33, which water rights referred to a then existing spring and reservoir located in the described premises. Said rights do not include any rights in the newly constructed well, completed in September, 1966. For title reference, see Deed recorded with the Berkshire Middle Registry of Deeds at Book 825, Page 318. The description of the property that appears in the mortgage to be foreclosed shall control in the event of a typographical error in this publication. For Mortgagors' Title see deed dated September 22, 1966, and recorded in Book 825 at Page 317 with the Berkshire County (Middle District) Registry of Deeds. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. Other terms to be announced at the sale.
