NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Premises: 71 Cady Street, North Adams, MA 01247 By virtue and in execution of the Power of Sale contained in a certain mortgage given by Matthew J. Trombley and Jenele K. Trombley to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Academy Mortgage Corporation, and now held by PennyMac Loan Services, LLC, said mortgage dated September 25, 2013 and recorded in the Berkshire County (Northern District) Registry of Deeds in Book 1524, Page 591, said mortgage was assigned from Mortgage Electronic Registration Systems, Inc. as nominee for Academy Mortgage Corporation to PennyMac Loan Services, LLC by assignment dated May 31, 2019 and recorded with said Registry of Deeds in Book 1683, Page 437; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on April 7, 2023 at 02:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit: Beginning at an iron pipe driven into the ground at the northeast corner of land of Thomas R. Ellis and Mary J. Ellis; Thence westerly along the northerly line of land of said Thomas R. Ellis and Mary J. Ellis, seventy and two-tenths (70.2) feet to an iron pipe driven into the ground on the easterly line of land now or formerly of one Montagna; Thence northerly along the easterly line of land of said Montagna and in extension thereof, seventy- eight (78) feet to land now or formerly of Billings; Thence easterly along the southerly line of land now or formerly of said Billings, seventy and two-tenths (70.25) feet to an iron pipe driven into the ground at the northwest corner of land now or formerly of one Pellows; Thence southerly along the westerly line of land of said Pellows and land of Sweeney, seventy-eight (78) feet to the point and place of beginning. Excepting and reserving, however, a right of way over and through a strip of land in the southeast corner of the above described premises, which strip of land is fifteen (15) feet north and south and twenty (20) feet east and west. Together with a right of way ten (10) feet wide westerly from Cady Street along the northerly side of the premises now owned by William L. Sweeney and Erminia B. Sweeney, and Also a right of way fifteen (15) feet north and south and twenty (20) feet east and west from and out of the northeast corner of the land adjoining the premises on the south herein described, now owned by Thomas R. Ellis and Mary J. Ellis. Said right of way to be used as a means of ingress and egress for all purposes by the present and all future owners and occupants of the real estate adjoining the above described property on the south and east, as well as the property above described. Meaning and intending to convey and hereby expressly conveying, in mortgage, all and singular, the same premises conveyed to the Mortgagor herein by deed of Thai Poeuk dated September 25, 2013 and recorded in the Northern Berkshire District Registry of Deeds in Book 1524 page 588 The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. For Mortgagor's Title see deed dated September 25, 2013 and recorded in the Berkshire County (Northern District) Registry of Deeds in Book 1524, Page 588. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser.
