LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by H. Emerson Blake to CitiMortgage, Inc., dated July 26, 2005 and recorded in Berkshire County (Southern District) Registry of Deeds in Book 1631, Page 159 (the "Mortgage") of which mortgage U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2021-F, Mortgage-Backed Securities, Series 2021-F is the present holder by Assignment from CitiMortgage, Inc. to Green Tree Servicing LLC dated April 10, 2014 and recorded at said Registry of Deeds in Book 2247, Page 271, and Assignment from Ditech Financial LLC f/k/a Green Tree Servicing LLC to New Residential Mortgage LLC dated March 7, 2019 and recorded at said Registry of Deeds in Book 2521, Page 144, and Assignment from New Residential Mortgage LLC to LoanCare, LLC dated March 23, 2020 and recorded at said Registry of Deeds in Book 2628, Page 32, and Assignment from LoanCare, LLC to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2021-F, Mortgage-Backed Securities, Series 2021-F dated October 27, 2021 and recorded at said Registry of Deeds in Book 2731, Page 75, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 208 Long Pond Road, Great Barrington, MA 01230 will be sold at a Public Auction at 10:00 AM on March 30, 2023, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: PARCEL I: That certain tract or parcel of land situate in the northwesterly part of said Town of Great Barrington, on the easterly side of the highway which leads northerly from residence of one Thompson Seeley to Williamsville, said tract of land being bounded and described as follows: Beginning at a corner of land now or formerly of E. N. Hubbard, in the east line of said highway; Thence on said east line South 3 degrees 15' West 196 feet; Thence South 86 degrees 45' East 132 feet; Thence North 3 degrees 15' East 142 1/2 feet to said Hubbard's line; Thence on said Hubbard's line North 64 degrees West 143 1/2 feet to the place of beginning, being lot formerly occupied by Long Pond District school building and being the same parcel of land which was conveyed by the Inhabitants of the Town of Great Barrington to Katherine Shalley by deed dated January 14, 1909, and recorded in the Registry of Deeds at said Great Barrington, in Book 205, Page 41. The interest of the grantors hereunder being as sole heirs-at-law of the said Katherine Shalley, now deceased. PARCEL II: A certain piece or parcel of land located northerly of Division Street and easterly of the Long Pond Road, but not adjoining either, and bounded and described as follows: Beginning at a point in the northwesterly corner of land now or formerly of Myron M. Love, said point being also the northeasterly corner of other land owned by Denis R. and Mary B. O'Connor; Thence southeasterly 182 feet to the northeasterly corner of land of said Love; Thence westerly along other land of said Love 162 feet to a point, said point being the northeasterly corner of land now or formerly of one Dewey and the southeasterly corner of land of the aforesaid O'Connors; Thence northerly along said O'Connor land 142.5 feet to the point of beginning. Being all and the same premises conveyed to the mortgagor herein by deed of O'Connor Family Realty Trust recorded in the Southern Berkshire Registry of Deeds immediately prior hereto in Book 1631, Page 156. For mortgagor's title see deed recorded with the Berkshire County (Southern District) Registry of Deeds in Book 1631, Page 156. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
