MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by BARRY K. SUMNER to GREYLOCK FEDERAL CREDIT UNION, dated October 22, 2009, and recorded on October 22, 2009, with the Berkshire Northern District Registry of Deeds in Book 1389, Page 186, of which mortgage the undersigned is the present holder, for breach of the conditions of the said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 11:00 a.m. on the Sixteenth (16th) day of March, 2023, at the mortgaged premises described below, to wit, 186 South County Road, Florida, Massachusetts, all and singular, the premises in said Florida, Berkshire County, Massachusetts, described in said Mortgage, to wit: The land with buildings thereon, situate in Florida, Massachusetts, bounded and described as follows: Parcel II in deed of Corinna A. Poirot to the grantors in deed dated June 1, 2001, recorded in Northern Berkshire Registry of Deeds in Book 1027, Page 682, described therein as follows: "Beginning at a point in the southwesterly line of South County Road at the southeasterly corner of land the grantee described in deed of the grantors dated October 13, 1977, recorded with the Berkshire Northern District Registry of Deeds in Book 680, Page 609; thence in a southeasterly direction along the southwesterly line of said Road a distance of 208 feet; thence in a westerly direction a distance of 1,200 feet more or less to a point in the easterly line of land of the Commonwealth of Massachusetts, which point is 250 feet southerly from the southwesterly corner of the aforesaid I and of the grantee measured along said easterly line of the Commonwealth; thence in a northwesterly direction and northeasterly direction along said easterly line of the Commonwealth distance of 250 feet to said southwesterly corner of the grantee; thence in an easterly direction along the southerly line of the aforesaid land of the grantee a distance of 990 feet more or less to the point of beginning." The grantee referred to in the above paragraph is Michael P. Gerrity and the grantors referred to therein are Einar L. Oleson and Anna H.E. Oleson. The Mortgagor herein reserves his rights pursuant to Homestead recited in deed of Ralph W. Raney and Katherine G. Raney to Barry K. Sumner, dated October 20, 2009, recorded with said Registry of Deeds simultaneously herewith, and does not wish to terminate said rights notwithstanding any waiver that may be included in the within mortgage, but the Mortgagor does wish to subordinate same to the within mortgage. Meaning and intending to convey and hereby conveying, in mortgage, the same premises conveyed to the Mortgagor herein by deed of Ralph W. Raney and Katherine G. Raney, dated October 20, 2009, recorded with said Registry of Deeds simultaneously herewith. Said premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, prior liens, mortgages and other enforceable encumbrances of record having priority over the mortgage described herein, and subject to, and with the benefit of, all easements, restrictions, improvements, reservations and conditions of record, and all tenancies and/or rights of parties in possession, including rights or claims to personal property installed by tenants or former tenants now located on the premises. It shall be the bidder's sole responsibility to ascertain all items described in this paragraph and no representations are made concerning compliance with applicable zoning, building, sanitary or other state and/or municipal laws, ordinances or regulations.
