NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Brian Peter Connelly and Lisa Lottie Connelly to Blue Bear Mountain Limited Liability Company dated April 13, 2021 and recorded with the Northern Berkshire Registry of Deeds on April 14, 2021 in Book 1748, Page 461, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00AM on Tuesday, December 13, 2022 at 23 South County Road, Florida, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, to wit: Being the parcel more particularly described in a Plan of Land drawn by Hill Engineers, Architects, and Planners of Adams and Dalton, Massachusetts, dated September 14, 2020 and recorded at the Northern Berkshire Registry of Deeds on October 20, 2020 in Drawer 0PL-B Page 349, said description being hereby incorporated by reference; Containing 12.585 acres more or less; Being the same premises conveyed to the Mortgagors by deed of Blue Bear Mountain Limited Liability Company, dated April 14, 2021, and recorded with the Northern Berkshire Registry of Deeds in Book 1748 at Page 458; Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: Bidders are required to make a registration deposit of five thousand dollars ($5,000), cash or by certified or bank check, prior to the start of bidding, in order to bid on the property. The registration deposit of the winning bidder will be applied against the contract price for the property and is non-refundable. Registration deposits of others will be returned/released at the end of the auction. The balance is to be paid by certified or bank check at the law office of Hussain A. Hamdan, 45 Pudding Hollow Road, Hawley, MA 01339 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. A buyer's premium equal to five percent (5.0%) of the high bid amount, or hammer price, will be paid by buyer to auctioneer for auctioneer's own account. The buyer's premium is earned by auctioneer with the fall of the hammer and is non-refundable. The buyer's premium will be added to the high bid amount, or hammer price, to determine the contract price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control. Other terms, if any, to be announced at the sale.
