MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Joanne Wentholt Conroy and James B. Conroy to Lee Bank dated as of May 11, 2004 and recorded May 17, 2004, in the Berkshire Middle District Registry of Deeds in Book 2931, Page 79, which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 a.m. on the 14th day of January 2021, on the premises at 11 East Street, Stockbridge, Massachusetts, all and singular the premises described in said mortgage, as Parcel I, and situated at 11 East Street, Stockbridge, Berkshire County, Commonwealth of Massachusetts, and bounded and described as follows: The following described piece or parcel of land in Stockbridge, Berkshire County, Massachusetts, bounded and described as follows: Beginning in the westerly line of the State Highway known as Route 7 leading from Stockbridge to Lenox at or near a Mass. Highway bound near the residence now or formerly of William Harvey Hornig et ux; thence north 24 degrees 21 minutes east 25 feet along said westerly line of said highway to an iron pipe; thence north 69 16 minutes west 522.99 feet to an iron pipe; thence south 24 degrees 40 minutes west 54.23 feet to other land now or formerly of said Hornig et ux; thence south 72 degrees 26 minutes east 526.34 feet along the northerly land of said Hornig et ux to the place of beginning. Containing .47 acre more or less. Also another parcel of land in said Stockbridge bounded and described as follows: Beginning in the westerly line of the State Highway know as Route 7 leading from Stockbridge to Lenox at or near a Mass. Highway bound near the residence of said Hornig et ux, now or formerly; thence north 72 degrees 26 minutes west 526.34 feet to a point; thence south 24 degrees 40 minutes west 225.74 feet to a drill hole and pin in ledge outcropping; thence south 65 degrees 31 minutes east 481.67 feet to an iron pipe in said westerly line of said Highway; thence north 32 degrees 32 minutes east 291.37 feet to place of beginning. Containing 2.95 acres, more or less. Shown on a plan entitled "Plan Showing Property of W.H. Hornig bordering on #7 Stockbridge, Mass. September 1946: recorded in the Berkshire Middle District Registry of Deeds in Book 417-A, Page 209. Together with such rights as the grantor may have and subject to the rights of other, if any, in and to artesian wells and water, and the pipes, machinery and equipment used in connection therewith, with the right to the grantees or any future owner of the above granted premises to enter lands, purchased by George S. Wallace and Anne W. Welch, Gdn. September 8, 1936, the deed being recorded in Book 476, Page 138 etc. for the purpose of repairing and maintaining the pipe lien from the pump house to the buildings on the above granted premises, provided said pipe line actually crosses said premises but subject to the restriction as to said pipe line. This conveyance is made subject to restrictions, and is intended to grant rights insofar as applicable to the premises herein conveyed, as set forth in deed of George s. Wallace herein conveyed, as set forth in deed of George S. Wallace et ux to David Williamson dated October 2, 1936, and recorded in said Registry of Deeds in Book 480, Page 27. Being the same premises conveyed to Joanne Wentholt Conroy and James B. Conroy by deed recorded May 3, 2000 in Berkshire Middle District Registry of Deeds in Book 1720, Page 756. The Mortgaged Premises will be sold and conveyed subject to and with the benefit of all restrictions, easements, improvements, leaseholds, tenancies, occupants, outstanding tax titles, municipal or other public taxes, liens, or other claims in the nature of liens, and existing encumbrances of record having priority over the Mortgage. In the event of any typographical error set forth herein in the legal description of the Mortgaged Premises, the description as set forth and contained in the Mortgage shall control by reference. TERMS OF SALE: TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) will be required to be paid in cash, certified or bank check with no intervening endorsements at the time and place of sale. In the event that the successful bidder(s) at the foreclosure sale shall default in purchasing the Mortgaged Premises according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder, providing that said second highest bidder shall deposit with the Mortgagee's attorneys, HUNTER & GRAZIANO, P.C., the amount of the required deposit as set forth herein within three (3) business days after written notice of the default of the previous highest bidder and title shall be conveyed to the said second highest bidder within twenty (20) days of said written notice. If the second highest bidder declines to purchase the Mortgaged Premises, the Mortgagee reserves the right to purchase the within described property at the amount bid by the second highest bidder. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale-date by public proclamation at the time and date appointed for the adjourned sale date.
