LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Timothy J. Rocca to Greylock Federal Credit Union, dated January 27, 2005 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 3147, Page 273 (the "Mortgage") of which mortgage Ajax Mortgage Loan Trust 2021-A, by U.S. Bank National Association, as Indenture Trustee is the present holder by Assignment from Greylock Federal Credit Union to AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB Trustee dated November 23, 2016 and recorded at said Registry of Deeds in Book 5887, Page 333, and Assignment from AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB Trustee to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to AJAX Mortgage Loan Trust 2017-A, Mortgage-Backed Notes, Series 2017-A dated June 21, 2017 and recorded at said Registry of Deeds in Book 6008, Page 254, and Assignment from U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to AJAX Mortgage Loan Trust 2017-A, Mortgage-Backed Notes, Series 2017-A to AJAX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee dated January 6, 2020 and recorded at said Registry of Deeds in Book 6560, Page 236, and Assignment from AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee to AJAX Mortgage Loan Trust 2021-A, by U.S. Bank National Association, as Indenture Trustee dated June 30, 2021 and recorded at said Registry of Deeds in Book 6995, Page 7, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 44 Meleca Avenue, Pittsfield, MA 01201 will be sold at a Public Auction at 11:00 AM on June 24, 2022, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: PARCEL I: Lot No. 19 as shown on plan entitled "Building Lot Plan No. 3 Laid Out by Frank Meleca, Pittsfield, Mass., August 12, 1955, Robert B. Deloye Engineer", recorded in the Berkshire Middle District Registry of Deeds, Book 417-C, Page 172. Said lot is located on the easterly side of Meleca Avenue and is 80 feet in width, front and rear, and 150 feet in depth. Said premises are conveyed SUBJECT to an easement to the American Telephone and Telegraph Company, dated August 31, 1928 and recorded in said Registry of Deeds Book 442, Page 206, insofar as the same is now in force and affects the granted premises. Said premises arc conveyed SUBJECT also to an easement to Western Massachusetts Electric Company et al., dated November 4, 1952 and recorded in said Registry of Deeds, Book 593, Page 87, insofar as the same is now in force and affects the granted premises. Said premises arc conveyed SUBJECT also to the following restrictions: 1. That no new building or structure shall hereafter he erected on said premises, any part of which, exclusive of piazzas, porticoes or any other unenclosed projections, shall be within thirty-five (35) feet of the westerly line of said premises. 2. That only one (1) single-family dwelling house, costing not less than $8,000.00, and a garage for not more than two (2) cars for private use, and no portion of any other dwelling house, garage or other building shall be erected on said premises. 3. That no cattle, poultry or animals of any description other than a household pet, shall be kept on said premises. 4. That no manufacturing, commercial, mercantile, noxious or illegal occupation, trade or employment shall be conducted on said premises. PARCEL II: Beginning at the northwesterly- corner of Lot No. 19 as shown on plan hereinafter referred to; Thence easterly along the northerly line of said Lot No. 19, 150 feet to the northeasterly corner of said Lot No, 19; Thence northerly at right angles, along the extension northerly of the easterly line of said Lot No. 19, 30 feet to a point: Thence westerly at right angles, in a line parallel to and 30 feet northerly of the northerly line of said Lot No. 19, 150 feet to a point in the extension northerly of the westerly line of said Lot No. 19; Thence southerly at right angles, along the extension northerly of the westerly line of said Lot No. 19, 30 feet to the place of beginning. Meaning and intending to convey and hereby conveying a rectangular strip of land 30 feet in width and 150 feel in depth, lying next northerly of Lot No. 19 as shown on plan entitled "Building Lot Plan No. 3 Laid Out by Frank Meleca, Pittsfield. Mass., August 12, 1955, Robert B. Deloye, Engineer" recorded in the Berkshire Middle District Registry of Deeds, Book 417-C, Page 122. Excepting and reserving to Frank Meleca the right and easement to enter into and upon that portion of the granted premises lying adjacent to the westerly line thereof and extending back from said line a distance of 10 feet along the entire 30-foot frontage of said premises, for the purpose of constructing, reconstructing, altering, repairing, and maintaining any future extension northerly of Meleca Avenue, and to perform all such grading, filling, excavating, landscaping and other work and construction in and upon said portion of the granted premises as may be necessary or incident thereto; provided however, that this right and easement shall terminate upon acceptance by the appropriate municipal authorities of any such street extension as a public way. Said premises are conveyed SUBJECT to an easement to the American Telephone and Telegraph Company, dated August 31, 1928 and recorded in said Registry of Deeds, Book 442, Page 206, insofar as the same is now in force and affects the granted premises. Said premises are conveyed SUBJECT also to an easement to Western Massachusetts Electric Company et al., dated November 4, 1952 and recorded in said Registry of Deeds, Book 593, Page 87, insofar as the same is now in force and affects the granted premises. Said premises are conveyed SUBJECT to the following restrictions, for the purposes of which the granted premises and said Lot No. 19, heretofore conveyed by the grantor herein to the grantees herein, shall be considered a single lot; 1. That no new building or structure shall hereafter be erected on said premises, any part of which, exclusive of piazzas, porticoes or any other unenclosed projections, shall be within thirty-five (35) feet of the westerly line of said premises. 2. That only one (1) single-family dwelling house, costing not less than $8,000.00, and a garage for not more than two (2) cars for private use, and no portion of any other dwelling house, garage or other building shall be erected no said premises.
