MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by JOHN T. GUZZI to GREYLOCK FEDERAL CREDIT UNION, dated February 10, 2012, and recorded on February 10, 2012, with the Berkshire Northern District Registry of Deeds in Book 1467, Page 26, of which mortgage the undersigned is the present holder, for breach of the conditions of the said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 10:00 a.m. on the Sixteenth (16th) day of December, 2021, at the mortgaged premises described below, to wit, 306 Houghton Street, North Adams, Massachusetts, all and singular, the premises in said North Adams, Berkshire County, Massachusetts, described in said Mortgage, to wit: The land with any and all buildings thereon located in North Adams, Berkshire County, Massachusetts, bounded and described as follows: Beginning at an iron pipe driven into the ground in the easterly line of Houghton Street, so-called, and at the southwest corner of land of the heirs of Charles E. Fuller; Thence easterly, along the southerly line of land of said Charles E. Fuller heirs, one hundred twenty-five (125) feet to an iron pipe driven into the ground; Thence turning an interior angle of 173 06' and running easterly along the southerly line of said heirs of Charles E. Fuller, twenty-nine and three-tenths (29.3) feet to an iron pipe driven into the ground; Thence turning an interior angle of 99 25' and running southerly, seventy-seven and eight-tenths (77.8) feet to an iron pipe driven into the ground; Thence turning an interior angle of 93 15' and running westerly one hundred forty-nine (149) feet to an iron pipe driven into the ground in the easterly line of said Houghton Street; Thence northerly along the said easterly line of Houghton Street, so-called, forty-one (41) feet to a stone bound; Thence northerly, along said easterly line of Houghton Street, so-called, fifty-six and five tenths (56.5) feet to the place of beginning. SUBJECT, however, to a right of way ten (10) feet in width along the northerly side thereof for a distance of one hundred (100) feet from the said easterly bound of Houghton Street, as mentioned and reserved in the deed from the heirs of Charles E. Fuller to Edward Morin et ux, dated February 28, 1928, recorded with the Northern Berkshire Registry of Deeds, Book 386, Page 49, for the benefit of whom the said right of way was therein reserved. Meaning and intending to convey and hereby conveying, in mortgage, the same premises conveyed to the Mortgagor herein by deed of J. Brian O'Connell, dated February 10, 2012, and recorded with said Registry of Deeds simultaneously herewith. Said premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, prior liens, mortgages and other enforceable encumbrances of record having priority over the mortgage described herein, and subject to, and with the benefit of, all easements, restrictions, improvements, reservations and conditions of record, and all tenancies and/or rights of parties in possession, including rights or claims to personal property installed by tenants or former tenants now located on the premises. It shall be the bidder's sole responsibility to ascertain all items described in this paragraph and no representations are made concerning compliance with applicable zoning, building, sanitary or other state and/or municipal laws, ordinances or regulations. TERMS OF SALE: FIVE THOUSAND DOLLARS ($5,000.00) will be required to be paid in cash or by certified check or bank cashier's check by the purchaser at the time and place of sale. The purchaser will be responsible for all the closing costs, recording fees, deed stamps and shall be required to sign an Auctioneer's Memorandum containing the terms of this sale. In the event the successful bidder shall default in purchasing the within described premises according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with the Mortgagee's attorneys, HASHIM & SPINOLA, the amount of the required deposit as set forth herein within three (3) business days after written Notice of Default of the previous highest bidder, and title shall be conveyed to the said second highest bidder within twenty (20) days of said written notice. This sale may be postponed or adjourned from time to time, if necessary, by the attorney for the mortgagee at the scheduled time and place of sale.
