NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Pursuant to the Conditional Judgment entered by the Superior Court for Berkshire County on April 16, 2019 in the matter assigned Docket Number 1876-CV-00223, and that Court's Order entered on December 24, 2019, and by virtue and in execution of the Power of Sale contained in a certain mortgage given by Paul Anthony Biagini to Greylock Federal Credit Union, dated September 10, 2004, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1174, Page 530, as affected by an assignment from Greylock Federal Credit Union to AJX Mortgage Trust, a Delaware Trust, Wilmington Savings Fund Society, FSB Trustee, dated November 23, 2016, and recorded with the Berkshire County (Middle District) Registry of Deeds in Book 1613, Page 346; of which mortgage the undersigned is the present holder by assignment, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 02:00 PM o'clock on December 9, 2020 at 534 West Mountain Road, Cheshire, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, To wit: a one-half acre parcel starting at the southwest corner thereof; thence running northerly on the mountain road; 11 roads to a stake and stones which corners on the Almira Bakeer Farm; thence southeasterly, 13 rods on the Almira Baker Farm to a stake and stones on the old road that leads to Lanesboro; thence westerly on said road to the first mentioned bound. Meaning and intending to convey and hereby conveying in mortgage all and singular the premises conveyed to the grantor herein by deed of Ronald R. Kruszyna and Virginia A. Kruszyna said deed dated April 10, 1988 and filed in the Northern Berkshire Registry of Deeds in Book 953, Page 63. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: A deposit of five thousand dollars ($5,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale.
