NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Premises: 86 Baldwin Hill Road Egremont, Massachusetts By virtue and in execution of the Power of Sale contained in a certain mortgage given by Marilyn Garth and Steven Garth to U.S. Bank National Association, said mortgage dated October 8, 2010, and recorded in the Berkshire County (Southern District) Registry of Deeds, in Book 2013 at Page 158 and now held by U.S. Bank National Association for breach of the conditions in said mortgage and for the purpose of foreclosing the same, will be sold at Public Auction on September 22, 2021 at 10:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit: Beginning at an iron rod to be set in the approximate easterly sideline of Baldwin Hill Road (North & South), said point being the northwest corner of the parcel herein described and a corner of remaining land of Stevens; Thence running North 74 degrees 37 minutes 00 seconds east a distance of 533.00 feet along remaining land of said Stevens to an iron rod to be set; Thence running South 89 degrees 46 minutes 59 seconds east a distance of 840.54 feet along remaining land of said Stevens to an iron pipe to be set in the northeast corner of the parcel herein described and southeast corner of other land of said Stevens; Thence running the following six courses and distances along land of Peck and of Curtiss: S 03 degrees 06 minutes 15 seconds E 282.78 feet to an iron pipe found; S 73 degrees 55 minutes 00 seconds E 24.78 feet to an iron pipe found; S 26 degrees 40 minutes 41 seconds E 27.28 feet to an iron pipe found; S 02 degrees 35 minutes 12 seconds W 31.28 feet to an iron pipe found; S 67 degrees 14 minutes 48 seconds W 32.80 feet to an iron pipe found; S 03 degrees 09 minutes 14 seconds E a distance of 800.64 feet to a point computed in the westerly sideline of Townhouse Hill Road; Thence running South 47 degrees 04 minutes 50 seconds W a distance of 19.87 feet along the westerly sideline of Townhouse Hill Road to an iron rod to be set; Thence North 04 degrees 52 minutes 50 seconds W a distance of 874.30 feet to an iron pipe found; Thence North 87 degrees 31 minutes 18 seconds W a distance of 690.54 feet along land of Schiff and Smith to a point computed; Thence running South 74 degrees 37 minutes 00 seconds E a distance of 533.02 feet along land of Schiff and Smith to a stone bound found in the southwesterly corner of the parcel herein described; Thence running North 24 degrees 38 minutes 06 seconds W a distance of 300.00 feet along the easterly sideline of Baldwin Hill Road (North & South) to the point and place of beginning. Being all the premises shown on a plan of land entitled "Plan of Land Surveyed for Milton L. Stevens in Egremont, Massachusetts" August - 1998, Scale 1" =120' recorded with Southern Berkshire Registry of Deeds, in Map File J, as Plan No. 155, and containing, according to said plan, 9.383 acres. Being the same premises conveyed to the grantor in two deeds, recorded at said Registry of Deeds in Book 1084, Page 185, and Book 1084, Page 189, and the same described in a deed recorded in Book 1154, Page 309. The description of the property that appears in the mortgage to be foreclosed shall control in the event of a typographical error in this publication.
