LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Tammy M. Cachat to Mortgage Electronic Registration Systems, Inc., as mortgagee, acting solely as a nominee for Loandepot.com, LLC, dated April 7, 2018 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 6171, Page 80 (the "Mortgage") of which mortgage MidFirst Bank is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Loandepot.com, LLC, its successors and assigns to MidFirst Bank dated March 25, 2020 and recorded at said Registry of Deeds in Book 6598, Page 75, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 103 Holmes Road, Hinsdale, MA 01235 will be sold at a Public Auction at 3:00 PM on July 27, 2021, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: Beginning at a point in the easterly line of Massachusetts State Highway passing through the Village of Hinsdale as laid out October 1, 1903, said point being marked by a Massachusetts Highway Bound opposite Station 42 plus 00.83 on the filed plan of said 1903 Layout; Running thence North 16 degrees 06 minutes East forty and sixty-two one-hundredths (40 62) feet to a point; Thence South 68 degrees 53 minutes 30 seconds East ninety-two and ninety-eight one-hundredths (92.98) feet along the southerly line of a Town Way formerly the private way of Francis H. Holmes; Thence South 33 degrees 55 minutes East one hundred fifty and sixty-one hundredths (150.61) feet in the said line of said plan entitled "Plan of Land in Hinsdale, Mass. Belonging to Francis H. Holmes, Scale: 1=40', September 1923, Henry C. Neff, Civil Engineer", recorded in Drawer No. 52 in the Berkshire Middle District Registry of Deeds; Thence North 87 degrees 47 minutes West one hundred eighty-five and no one-hundredths (185 00) feet, more or less, to a point on a curve of the northerly line of said State Highway as laid out in 1903; Thence westerly following the curve of the northerly line of said 1903 layout thirteen and no one-hundredths (13.00) feet to a Massachusetts Highway Bound opposite Station 43 plus 03.12 on the said 1903 layout; Thence North 2 degrees 09 minutes East ninety-nine and thirty-two one-hundredths (99.32) feet to the place of beginning. EXCEPTING from the above-described parcel a certain parcel of land taken from the westerly portion of the lot by the Commonwealth of Massachusetts by Land Taking, recorded in the said Registry of Deeds in Book 426, Page 30, and which is shown as the "TAKING OF MAY 26, 1925". Being the northerly portion of Parcel No. 4 in a deed from the Hinsdale Trading Corporation to Samuel Sagarin and Abraham Adelson, dated March 4, 1931, and recorded in the Berkshire Middle District Registry of Deeds in Book 449, Page 481. Also conveying a right of way for all the usual purposes of a way over the old roadway running westerly and southerly from the Massachusetts State Highway at a point opposite Lot No 3 on said plan, thence continuing southerly near and approximately parallel to the westerly lines of Lots 17, 18 and 19, on said plan and connecting with each of said parcels on its westerly line. The above-described premises are subject to certain old rights of way of record as referred to in the deed of Hinsdale Woolen Co. to James M Morrison, dated July 12, 1907, and recorded with the Berkshire Middle District Registry of Deeds in Book 337, Page 240. Meaning and intending to describe the same premises conveyed by deed dated and recorded June 15, 2007 with Berkshire County Registry of Deeds in Book 3819 Page 168. For mortgagor's title see deed recorded with the Berkshire County (Middle District) Registry of Deeds in Book 6171, Page 77. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA 01851 or such other time as may be designated by mortgagee.
