Snyder, his heirs, successors and assigns and any and all persons by and through them, specifically including: William Snyder, Jr.; Melissa Allen; Shirley Snyder Roots; Joseph Snyder; Jeffrey Snyder; John Snyder, Jr.; Susan Crane; Lisa Gomez; Lorraine Snyder Love; James M. Snyder; David V. Snyder; Lawrence Ball; Robin J. Ball; Nancy Peck and all other persons interested; A Petition for Partition, last dated May 12, 2026 and filed May 27, 2026, has been presented to said Court by Thomas Sindler of Lehigh Acres, Florida and Nancy Romboli, of Cape Coral, Florida, representing that they hold as tenants in common an undivided part or share in certain real estate situate in Great Barrington and Egremont, Berkshire County, Massachusetts, and briefly described as follows: Locus of Property: 0 Creamery Road, Egremont, MA, 57.9 acres of land, more or less; Locus of Property: 0 Creamery Road, Great Barrington, MA, 50.9 acres of land, more or less A certain farm of land, with buildings thereon, situated in the towns of Egremont and Great Barrington, known as the Lydia Austin Farm, bounded North by land formerly of Michael Cronin, deceased; East by land of one Cronmiller, and land of George B. McPherson; south by land of Henry Smith, land of Ransom Rogers, and land of Maud M. Greenwood and West by the highway. Also hereby conveying the three acre piece between the roads, being the farm of land which was conveyed to my late father, Matthias Snyder, deceased, by Justin Dewey, Administrator of the Estate of Lydia Austin. EXCEPTING OUT the following: 1 Deed from Matthias J. Snyder, Guardian of Martha D. Snyder to Charles Reed, dated September 9,1911, and recorded on September 14, 1911 in Berkshire Southern District Registry of Deeds in Book 209, Page 231. 2 Deed from Matthias J. Snyder, et als to Berkshire Stone Products Corporation, dated September 7, 1920 and recorded on September 9, 1920, in said Registry of Deeds in Book 216, Page 232. 3 Deed from Herbert C. Joyner, Trustee under the Will of Matthias J. Snyder to Stephen Nelson, dated June 18, 1925, and recorded on June 19, 1925, in said Registry of Deeds in Book 238, Page 333. 4 Deed from Matthias J. Snyder et als to Will M. Willcox, dated September 13, 1932 and recorded on September 27, 1932, in said Registry of Deeds in Book 253, Page 153. 5 Deed from Matthias J. Snyder et als. to Clinton Schneider and Sophie Schneider, dated September 15, 1937, and recorded on September 23, 1937, in said Registry of Deeds in Book 257, Page 193. 6 Deed from Matthias J. Snyder et als. to Martha Abdalla, dated December 16, 1950, and recorded on December 18, 1950 in said Registry of Deeds in Book 276, Page 369. 7 Deed from Matthias J. Snyder et als. to Thomas M. Sindler, dated September 30, 1954, and recorded on October 1, 1954, in said Registry of Deeds in Book 307, Page 196. Being all and the same premises conveyed to Martha D. Snyder by deed from Matthias Snyder, dated April 28, 1897, and recorded on April 29, 1897 in the Berkshire Southern District Registry of Deed in Book 169, Page 441. See also deed to Matthias J. Snyder from Justin Dewey, Administrator of the Estate of Lydia Austin, dated March 10, 1879, and recorded on March 12, 1879 with the Berkshire Southern District Registry of Deeds in Book 140, Page 206. And that said Petitioners wish to hold said real estate in severalty. And, if the Court finds that said land cannot be advantageously divided, the petitioner prays that all of said land may be sold at private sale for not less than One Million and No/100 Dollars ($1,000,000.00) and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided, either at private sale or public auction, and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 14th day of August, 2026, the return day of this citation.
